Hey all,

I'll be marrying my fianceê in just a few weeks, very exciting! We're living in São Paulo, Brazil. I'm a US citizen, she is a Brazilian. I will be applying for permanent residency here in Brazil within a few weeks as well, and was wondering if the DCF process is possible through the São Paulo US embassy? I've heard it can only be done if you have permanent residency status, however it takes extremely long, sometimes years, to obtain permanent residency here. I will, however, obtain a type of "temporary" residency as my permanent residency is being processed. I hope that me and my wife can move back to the US before the end of the year, and ideally, even if the DCF doesn't work here, we get the expedited visa due to living abroad. However, I'm still hoping a pending permanent residency status will be enough to gain us the DCF filing status!

I don't have my hopes pinned on it though, but we will get through it one way or another. Does anyone have any advice for me, regarding the IR-1/CR-1 process, DCF, or the visa process for my wife coming from Brazil?

Any fellow US/South American expats, I'd appreciate any info! Here in Brazil, the bureaucracy can make your head spin, so any help would be really appreciated.

I did e-mail the US embassy here in São Paulo, as they do not pick up the phone. However, each time I e-mail them, it's talking to a different person each time. So I'm hoping with the combination of contact with them, and help from others on here, I might be able to set the record straight on this.

Thanks all!

J

There is no longer DCF in Brazil. The good news is that if you file your I-130 to the Chicago Lockbox and indicate all over it that you are residing in Brazil, it will likely be approved quickly.

3/2/18  E-filed N-400 under 5 year rule

3/26/18 Biometrics

7/2019-12/2019 (Yes, 16- 21 months) Estimated time to interview MSP office.

Unfortunately, no more DCF in Brazil, so you are out of luck on that one. But you are correct - you will have your US visa way before brazil gets through processing your permanent residency.

Hey jworld -

I am in a similar situation. I am here visiting my fiance in Sao Paulo. We just got engaged this weekend and are trying to decide what to do next!

I live in Atlanta, GA and she lives in Sao Paulo. We obviously want to live together asap and plan to get married legally as soon as necessary. One of our issues is that it is important to both of us to have the ability to continue working during the immigration process. She has a good job in SP and I am about to start a new career in Atlanta. We would like to be together in the US next year but she doesn't want to quit her job in SP until her Visa is approved and she has a new job lined up in the US.

Can you please update me on the situation with you and your fiance? Did you determine that DCF is absolutely not possible in Brazil at this point? Did you end up getting married and filing for an IR1 in the US? How is it going? What phase are you currently in?

Did you have anyone help you? Attorney, immigration specialist, etc.???

Do you have any advice? We have so many decisions to make and are just learning about the immigration choices. We are a bit overwhelmed. Your advice would be appreciated. Thanks!!!

Hi guys the name's Mark....

I am married am ready to start filing for my spouse but people at agency are saying that it could take anywhere from 2-3 years for the process to go through....is that true. Should I just file the paper myself? I guess the I130 is easy enough but the proof of domicile and financial responsible might be tricky since I have been living her for almost 8yrs. Any help or advice would be great. We would love to move in like a year or a year and a half......maybe that's not possible :(

Mark

That is the list of places that offer DCF. Brazil is not one of them.

Spouse filing is pretty straightforward. Click "guides" at the top and start reading.
