Hi evrybody,

I am American citizen and I am applying for IR-1 for my husband at Madrid. We got approval from USCIS and now we need to send i-864 and tax return.

But my case is a little complicated. I have not been in USA since I was 2 years old and I did not have SSN and income during these years. Now, I am housewife and my income is zero while my husband is Doctorate student and he has income from university. Now I have some questions:

1. Can I write a tax exemption letter for not filling in tax return? (According to i-864ez instructions (on the actual form)it states "If you were not required to file a Federal income tax return under U.S. tax law for any other reason, attach a written explanation including evidence of the exemption and how you are subject to it." )

If NO:

a. How I can fill in tax return? I checked the IRS.gov website but I do not know for which type of tax I have to apply. Can I get tax return while I do not have SNN?

b. Do we need to apply for tax return jointly with my husband? (Because he has job and income from University?)

2 . Since my income is under 125% poverty limit, can my uncle co-sponsor me for i-864?

First, you cannot use the I-864EZ. Use the I-864, one from you and one from your qualified joint sponsor. In YOUR I-864 simply hand print in the prior tax information section, "Not required to file because I had no income.) You'll sign the affidavit and that's all the explanation you need.

If your uncle is either a US Citizen or green card holder actually residing in the USA, and he qualifies financially, yes, he can be the joint sponsor.

Yes for sure I am filling in I-864, but I do not know in which section I can hand print "Not required to file because I had no income"?! :unsure:

Look at the form. There's a section to enter income from past tax returns. Use available space there, as needed to hand print what I wrote.
