Well here goes my story.i was brought to the US at the age of 6 & from there I never left the US until last June & that Es because my husband filed for me under the cr-1 condition!my lawyer told me that in order to not be illegal in US I had to leave before my 18 years 6 months or else I'd be violating the law.but now that I'm two days away from going to my appointment im getting a bit nervous because I have been researching that even tho I left before that due date I still need to file a waiver at ciudad Juarez embassy & that would take months.can anyone with similar experience help me?

What age were you when you left the US?

You should not be required to present a waiver. Unlawful presences starts accruing only after your 18th birthday and you're only banned if you have accrued 6 months or more of unlawful presence. So since you left 2 weeks before having 6 months of unlawful presence you should be fine.

Essy_A thank you very much,I guess I got a bit nervous because I'm actually 7 1/2 pregnant & I really wanna go back home before my due date, one more question so when I go to the interview I have to show the officer proof of when I left the US,such as the airplane ticket?

Posted (edited)

You really are cutting it close there on the pregnancy. Check on airline regulations on flying while pregnant before buying your fare (or you could always just hope they don't ask how many months you have :-/ ).

Technically it's 180 days of overstay that incurs a three year bar.

You should get a calendar and count the days between your 18th birthday and the date you departed the US, to make doubly sure this does not apply to you.

You may need to show proof that your overstay was under 180 days.

I did check right know & to be exact I stayed for 170 days only.the proof that I have is the airplane ticket which shows exactly when I left the US & the time too.& on top of that 3 days later when I was already in my birth town I got my drivers license & that has the time, date,& the stamp from the government.do you think that should be enough proof?

Posted

I think you should be ok with the proof you have. You may not even be asked for it, but it's best to have it and not need it than need it and not have it.

So I'm guessing my appointment went well!but I'm really confused, the interviewer told me my visa was approved and that I should be getting it in a week or so but he didn't give me dhl no tracking number or anything like that, but he gave me a paper that says I have to pay $165 dollars to USCIS.

My question is how do I track my package or did I do something wrong & left earlier than I was supposed to?

That is the green card fee. Congratulations, you're getting one! Call the NVC to see if they can give you a tracking number.

Thank you!

On the paper that they gave me for the fingerprint appointment it says to log in at this website www.usvisa-info.com,which I did and at the very middle it say "there's no information on the DHL waybill at this time" does that mean I have to be pacient & just wait & check tomorrow morning?

Yes, knowing DHL, you should give it one more day, and then if you still don't see it, call the NVC and ask for the number.
