hello vj members. just wanted to know if it makes a difference if my wife and myself file jointly or file not jointly but marry when we send out our 1-751 package in ten days. i just wanted to know if this would make a difference. last year, we had file jointly but this year if we file jointly, we will either owe the irs or we would come out even. any replys will help. thank you everyone.

If you have two years of joint returns, then that probably is sufficient as an evidence from tax perspective. You can file the third year (this year) separate and not send third year tax return as an evidence since tax returns are only one of many other supporting documents.

If this year is your second year filing as married then you should file the way it makes financial sense (separate in your case) and send it along with a note that you filed separate as it was financially better option than to file jointly, and that the returns indicate you live in the same household nonetheless.
