Timeline

i had interview on 16 juan 2013 for 130 petition at uscis office, my interview went good then the officer she got document said that my husband he commit fraud for his previous interview for fiance visa he had on 2010 with another women,so the officer say i can not approve your petition

please i need help and advice on what to do because i did know that my husband he had been denied for his fiance visa he had before. but the only paper they give him at morocco at his interview was221 g for more information

please i realy do need your help?

I'm very sorry for you , you must be devastated to get that news. It seems they have proof of fraud on your husband, and nothing will change their mind at this point. Was there an explanation to USCIS as to the reason the first fiance visa was abandoned with the other woman, they weren't provided the additional evidence they requested? I'm sure it appears to be a big red flag to them to have him in another relationship so soon with another woman petitioning for him. I would suggest getting advice from an immigration lawyer.

The US citizen (Patty) was called in to USCIS to interview, she was told her petition was denied (I-130) due to fraud committed by her husband with a prior woman he was engaged too in 2010. That is my understanding :)

And the USC doesn't know that her husband had applied and was denied a visa?

If that's the case, then USCIS did her a good favor by denying him.

It states in the initial post that she did know of the past fiance visa, but i'm betting that she didn't list it on her application that he was denied in the past. For example my husband (fiance then) was denied k-1 visa in 2010( to me), then we married in 2012 , there is a place on the I130 petition where I needed to write that I petitioned in the past for him. I don't know if this applies if her husband was petitioned by another to write that in?

Petitioners are not always native English speakers.

Key here is to see if you can get a hold of 221g from him to see what it said because according to USCIS they categorized him for visa fraud then in two years he is married yet to another American but the outcome of the last visa request never changed. Also as stated did you list it as a previous petition. It is such a big red flag they are not so much as processing the petition, I would suggest an attorney.

Sorry for the situation but thank you for sharing it helps others in the same situation to ensure their significant other close out previous petitions with the consulate or USCIS or USC who find themselves in this situation to verify their significant others previous visa status.

Was his interview before or after yours? Did the officer at your interview give you any paperwork? Have you read the pinned topic above re. denials? Or anything in the waiver forums?

If you want specific advice then you need to tell us specifically what the 221g form he was given said.

There are different types of 'denials'. Some are not 'flat out denials' Some are requests for evidence- when you submit the evidence, your case will move forward. Your post contains several contradicting statements- a claim you were denied for previous fraud (meaning hes potentially 'blacklisted' and a visa will never be possible) a mention that there was a previous visa you didnt disclose (which could be fixed by re-applying correctly) and a mention that a 221g was issued for more information (what information?)

So in order to receive proper advice on your next step, you need to post what exactly the form 221g states/ what boxes are checked.
