I am the K1 beneficiary from the philippines and here in our country, we take our middle names after our mom's lastname. She changed her lastname through court which affected mine.

In all of my ID's and passport i have the new middle name, only in my birth certificate shows my old middle name but it also has a notation that I indeed had a legal name change.

Do i still put my old middle name for questions about other names used in I-129f? and send the proofs about it? for proofs, would i still need to provide the court decision or the notation on my birthcertificate is enough?

I am very troubled and i want to know what to do before we start filing the I-129f package.Me andy fiance would very much appreciate every advice we could get.

middle name here is if you have two names like raoul jason.. jason then will be your middle name.. your middle initial which is your mom's last name is not used.. i have since dropped mine in all my applications with uscis and never had any problems..

N-400 filed based marriage to usc = april ??

biometrics = june 21

interview = august 2

done..

thanks for taking time to read this. Yes I could do that, but im afraid that when the time that they would review my birth certificate it would show that I have a middle name there(mom's lastname) Do you think it would be okay if the I-129f form contents is not the same with my birth certificate?

i do not think that you will have a problem if you put it since you have a notation on your birth certificate... further, when you apply for NBI clearance... make sure that you also put in "other name used" in the NBI clearance application, some people got 221G because of this, which made them wait for weeks more...

Please bear with me, my bad, i meant g-325a form. So putting my old middle name should be okay in the other names used? Should we include in the I129f package my birth certificate as well for proof?

Me and my fiance thought that I only have to fill in "others name used" only if i was married before. But reading through the guides i got worried because of the legal name change thing.And u can tell that i am very confused.

For your name you would put your current name, that would be the name on your passport. You would fill out your first, middle and last. In the space listed- other names used, you would list any other names used- that includes maiden names or names you had prior to any name changes.

Since you had a name change, you would list your name before the name change there. You have 2 documents supporting the fact that you had a name change- a court decision and a notation on the birth certificate, so include them both. While the notation itself establishes the fact the name change occurred, you have another document (a court decision) why wouldnt you submit it?

Of course its okay that the name on your birth certificate is not the name on your passport or the name on the top of the 129f. You had a name change. It would be impossible for them to match. That is why youre submitting proof of the name change! Its very common. (I personally have documentation of 6 different names between the name on the top of the form and the name on my birth certificate)

Its the same procedure for the 325 or any AOS or any immigration paperwork that asks for name/previous names used.

Yes. You should check out the guide section on the forum.

As part of the 129 as the beneficiary you will fill out the 325. You will need to disclose all prior names for a background check. Later on in the AOS, you will fill out the 485. this requires your birth certificate among other documents.

Your concept of "I can leave out the middle name because its not on all of my IDs" is not true. Its not on all of your IDs. Your birth certificate is one of your IDs. It has a different name then your passport.

Put it down properly at the beginning in the right location or you will run into potentially having your petition denied for misrepresentation or delayed with a request for evidence (proof of name change). You may even potentially fail the background check.

If your additional question is just out of curiosity about the process because youre new and its all overwhelming then start with the guides. They are very user friendly. Start with 'K1 visa guide' and then check out 'adjustment of status guide (k1 and k3 visa holders)' for what you would do after you are married and in the US

However if you are asking because you are considering omitting the fact that you changed your middle name--- big mistake. You cant omit something like that. It will be found out.

Great!

I am going to redo and thoroughly check my g325a now and put my name with my old middle name in others name used field. enclose it with proofs about my legal name change. and go send it again to my fiancee. (The resending part is expensive but i guess we dont have a choice if we want to file it soon.)

It feels so much better to know what should be done. Thank you very much for taking time to read and answer my queries.
