Hello all,

I am working on the I-134 Affidavit of Support and have a couple questions for those of you that have been through it all.

1. Do I need to list my children (4 children) under the age of 18 as wholly dependent even if they are with the ex-spouse?

2. Do I need to add the ex-spouse (a US Citizen) as a dependent in whole are in part if part of the divorce was to pay alimony and child support?

3. Does the alimony I pay count against my income for the standard?

4. Does the child support count against my income for the standard?

5. Is my income enough?

Employer gave me a letter stating that I make a base of $41,600 USD

I have been employed for 7 months and have made more than that($42,131 in 7 months) with the over-time that is mandatory.

I know this may be a long set of questions and maybe sharing too much information but I think the more info I give the more accurate the answers will be.

Hello all,

I am working on the I-134 Affidavit of Support and have a couple questions for those of you that have been through it all.

1. Do I need to list my children (4 children) under the age of 18 as wholly dependent even if they are with the ex-spouse? - Yes.

2. Do I need to add the ex-spouse (a US Citizen) as a dependent in whole are in part if part of the divorce was to pay alimony and child support? - No.

3. Does the alimony I pay count against my income for the standard? - No.

4. Does the child support count against my income for the standard? - No.

5. Is my income enough? - Yes. A household of 6 needs at least $38,712 gross total income: http://www.uscis.gov/files/form/i-864p.pdf

Employer gave me a letter stating that I make a base of $41,600 USD

I have been employed for 7 months and have made more than that($42,131 in 7 months) with the over-time that is mandatory.

Provide the letter and most recent pay stub(s) that show year to date income totals along with your most recent tax transcript.

I know this may be a long set of questions and maybe sharing too much information but I think the more info I give the more accurate the answers will be.

Have one more for you out there!

When the I-134 is completed and signed by me do I send it to my fiance for her to take in? or do I send it elsewhere?

The instructions on where to send this are vague at best!

Thanks!!

Thanks Jay-Kay !!

Do you have any sample "Letter of Intent?"

From what I am reading and understand, my fiance needs to write one as well. Correct?

Thanks for all your help!

-Chris

Same ones as you sent with the I-129F petition. Just make new ones for the consulate. See the example forms here on VJ.

Thanks Jay-Kay !!

I have been reading that some people are sending in the IRS tax transcripts and others are sending in the W-2/1099 and the 1040. I have the W-2's and the 1040's that were sent in. is one better than the other? and do they need to be "certified" or "notarized" ??

Thanks again for all your help!!

-Chris

You should take either a complete copy of your tax return with all forms, schedules, W-2s and/or 1099s, or a tax return transcript from the IRS. Either one works, unless your consulate specifically requests one or the other. No need to get anything notarized.
