I plan to file the I-130 for my Italian husband through the US embassy in Rome. I am a USC and once I file, I plan to return to the US to work for a few months in order to gain some work history for the I-864 Affidavit of Support. To top things off I am currently pregnant and due in August. Does anyone have any input regarding how long the I-130 will take to be approved and how long until my husband can have his interview and travel packet in hand? The goal his to have him in the US prior to the birth of the baby. Also, once I move out of Italy, how do I make sure I receive all the proper documents from the USCIS as my address will change from the one on the petition? Any input is greatly appreciated. Thanks.

When we filed DCF it took us a grand total of two months before we had the visa in hand. We did deliver everything in person though since we lived only about an hour away so we didn't have to wait on the mail system. I'm not sure how quick Italy is but your husband should definitely be stateside before your kiddo is born.

I am hoping the process is smooth, although, as you probably know, the unknowns now are a bit stressful :) Once accepted, do you know if they send all the follow-up information directly to the beneficiary? I am worried they will try to send things to me and I will no longer be in the country.

Pretty sure everything will be sent to his name. If you want to double check you can try calling your embassy there. It's not too frustrating to get a hold of someone, at least it wasn't with ours.

Hi, I have tons of questions; help for any would be helpful. Let's begin complicated (smile). Married in US: 7/2011. Lived sep for 6 months. Husband (Italian) came and sayed to help us pack and leave together for Italy (myself, him and two daughters age 11,14). Arrived to live in Ladispoli June 2012. Officially anounced to police we were living there 7/2012). Submitted forms to immigration but had to get extra translations in Aug 2012. Told to submit marriage cert. to Ladispoli before applying for immigration. Accepted. Kept checking and it was fine. When we went to immigration (by that time, at the end of the process) it was Oct. Said it was rejected in Ladispoli. Returned to Ladispoli and could not see the man again for a month due to his being on vacation. Finally were told they didn't accept the county of marriage certificate. Was fixed and resubmitted. We sold home (was his family home; decided to find our own), moved, went to immigration. Road Block. He had to change his residency before we could resubmitt marriage certificate in new comune. Six months (yes kids, I am being sincere) after babggering and harrassing a man whom truly hated us as to why the residency was not changed, we were finally changed in the computers and we could resubmit certificate. We have moved to Rieti instead of Rome area and we went to their office next (after the general month or two it takes for the marriage certificate to register. We were told we only needed the form to show it was changed but that was not acceptable here). We were upset by this time as it had been over a year we were living here trying our hardest to get this taken care of and done right but with every step thwarted. We payed school taxes, girls were registered and we expressed our concerns for fiscal delay, etc several times. They just replied it was no problem and to just wait. Long story short. We would like to return. My id should be in now in Oct (please, please. They said it was the end of the process now). I have not worked nor filed since I left the states. Several questions. First, do we now have to wait until March to try to apply DCF since that is 6 months from the time I am really sure to have the ID? Then, we have not been able to join anything in our name here as I have had no ID (FRUSTRATING!). All my savings was put into my husbands accounts. We have thousands of pics together and lived here together (obviously) for a year and a half now. Very few friends we would ask to submit statements to validity but we have lived as a family both here and visits in America with our daughters. Would this be sufficient? My daughters can easily testify to this (a large part of the reason we are leaving; it has been a hard year for them in the schools, etc and adjustment). Then, a biggee, we now have approx 200.000,00 euro in assetts ONLY (our home, a home as part of an inheritance that is now up for sale, a store as well also up for sale, a home we purchased in the US we plan on having as domicile, two cars [one value can be used for around 6.000 euro) and then our savings at around 32.000,000 euro in our account. Our home is for sale and will be sold realistically within the year while at least one other home in the inheritance (with his and his cousin's name on it-value split and already accounted for in appraisal) will sell within the year also as they are eager in price and the area is inside Rome. As anyone gone for this time, I worked for over ten years in the schools before but not in the last two years being here. I have a job to go to readily as the home we found (bought for this very reason as well as the value and size for our family) but no proof of that. We are understanding that with our family, we have to have $144.604,00 usd for 5 times the 125% poverty level with a family our size. We can meet that (and believe me we understand that we are very fortunate as this was never an option before for us) but also want to be certain of the limitations on the assetts. If anyone has any experience with this, it can be helpful. We will not return without at least this home here selling and are very sure it will be liquidated without a problem. Does anyone foresee any hesitation in immigration for the other assetts being up for sale but not liquiditable yet? My husband works part time here and will be until we leave as well (to show prior stability). Any suggestions or thoughts to this would really help. Sorry for so long and thank you in advance.

Hi there, I do not see any problem with your assets being used and accepted by the Embassay in Rome. My husband and I also obtained his visa via DCF through Rome in February. Our scenario is a bit different than yours given that we did not have children and I came back in February to show proof of income necessary for the later interview in Naples. Now as for your concern with the 6months of legal residency in Italy to even petition through DCF, I wouldn't worry much about it. I don't believe my ID card was quite 6 months when I filed and it did not seem to be a problem. Do you have some sort of permission to stay (permesso di soggiorno)??? That would also work to prove your legal residency and you wouldn't even have to worry about the ID card. I hope I was helpful somewhat, although your post was a bit long and I may have missed some of your questions.

Thank you so much for your reply; it helped a lot. The permesso is what we had applied for and do have a temporary paper to show we did this.We were told we needed only to wait the official letter, go to office for fiscal code and have id printed and picked up from comune. Also working on the fact that my attempt to learn Italian has not been so pretty (smile) and relying a lot on how my husband can translate to me what is going on in each step. Can't imagine how he does it with us 24/7 (smile). Sorry for the length; worried about every detail actually. How long did it take for your process? We actually had thought at first that it would be some years for this process; really were not aware of DSF.

I am waiting for my 6 months time of living in Italy as well to apply DCF. I have contacted USCIS Rome with random questions and they have made it clear to me that I won't be approved unless I am living here 6 months and can prove so...and I am a Dual USA/ITAL citizen. I'd be surprised if they are lenient with this qualification, but kudos to anyone who was able to apply under the 6 months. We would love to start our new life together asap, but we will wait out a few more weeks with the hope that all other I-130 components are enough!

DCF at the Embassy in Rome. then if approved, Naples Consulate takes over.

I do not think he can hand deliver the I-130. I think that is strictly for the US citizen to submit whether in person or via post. Better wait to hear from others on VJ. They are much more seasoned than me.

As you are petitioning for your husband, you would have to present the I-130. Are you living in the U.S. now or just visiting?

IR-1 visa by Direct Consular Filing in Rome:

03.07.10 - Got married in Italy

01.11.10 - Moved to Spain

02.08.13 - Moved back to Italy

09.20.13 - I-130 filed at US consulate in Rome

10.18.13 - Received NOA2

10.24.13 - Received packet 3 via email from Naples

11.26.13 - Interview at Naples consulate. Approved!!

New questions if anyone can help. Wanting to file DCF May 1 (just now have permesso-need 6 months). We are selling house here; should have it sold by June realistically. We are sure I am returning as best option to US to purchase home and set up domicile in Jan (been here year and a half-long story-problems with paperwork). Planning on 6 weeks, returning in March.-thinking for my husband to take the trip with us but don't want to create problems with DCF in May. Anyone have advice or knowledge on whether it would go against us if he accompanied me to visit and set up domicile and return? We are in the hopes to be leaving with his green card in or around Sept and plan to leave permanently at that time.
