Im wondering how everyone is filing their tax returns while theyre back here in the States and their spouse is abroad with no SSN. I wanted to file separately but I will be missing out on ALL my deductions. Can I file "together" even though he has no SSN?

3. The original documents, or certified copies of these

documents from the issuing agency, that support the information

provided on the Form W-7. The supporting documentation must

be consistent with the applicant's information provided on Form

W-7. For example, the name, date of birth, and country(ies) of

citizenship must be the same as on Form W-7, lines 1a, 4, and

6a.

You can submit copies of original documents if you do any of

the following.

Have the copies certified by the issuing agency.

Have the officers at U.S. Embassies and Consulates overseas

provide certification and authentication services. Contact the

Consular Section, American Citizens Services of the U.S.

embassy or consulate in advance to determine the hours of

operation for these services.

Why is your spouse in another country?

Doesn't that defeat the purpose of getting a green card?

Why also does he refuse to get a SSN?

We're in process of getting his CR1 visa.. So he can't be in the states nor have a SSN until the process is completed.. Hes not refusing to get one, but he can't until he has the visa..

To clarify:

Simply a "copy" as done by the petitioner is not enough.

The original passport and marriage certificate? Worried about sending those in and getting them back in time to send the marriage certificate to the NVC. Maybe I should wait until later?

Yea, the new W7 requirements suck.

Doesn't need to be original, you can get a copy from the issuing source.

Original marriage certificates (which are actually just certified copies) shouldn't be an issue for you.

If you were married in the states, you should have requested multiple copies for issues such as this.

I have 5, for example.

My next question/research topic is: does his out of country income earned get included in this? He pays taxes in NZ on his income, I would imagine that its not also subject to US taxation because it is not spent here..

Actually marriage certificate is not needed at all. I know, because I just got ITIN for my husband. W-7 and a 'certified copy' of spouse's passport. The certified copy need be issued by the passport issuing authority. That's all you need.

Yes, his income gets included on your taxes.

You will also include the taxes he paid to NZ on there as well.

If those things will affect the outcome and how to do it, I do not know, as my husband made nothing both years that I claimed him.
