Hi Everyone,

I'm getting myself prepared for 2012 Tax filing. My husband is in Mexico and our petition was recently approved :dance:

I am the petitioner. My husband works in Mexico but doesn't earn a lot. I send him money every month. My question is, can/should i claim him on my 2012 tax filing? Would it affect the CR-1 process?

Also, i know we need to send the last 3 years of tax transcripts. Tax year filings for 2009, 2010 i had one dependant (my uncle) on my taxes. In 2011, i didn't claim anyone. Same for 2012, i will not claim anyone. Unless i can claim my husband. When looking at the chart to see what the minimum amount i have to make to qualify for the Affidavit of Support, do i have to include my uncle eventhough he is no longer a dependant on my taxes?

What is the minimum i have to make for me not to require a co-sponsor for 3 including myself? This would be worst case scenerio My husband, uncle, and myself. I will have made approximately $39,000 in 2012.

Can someone give me some advice in regards to this. I would appreciate it.

if you married you should file your taxes as married,don't metter where he lives. even if he don't work he has a social security card file joinly you will get a bigger refund,if you made over 39,000 you should be ok for 4 people on the 1-864,
