1 yes, have your husband start off the process, go ahead and file the I-130. No, the form I-864 is not needed until you are at the NVC stage which is many months away, this will give you a chance to gather documents to prove solvency and, for your husband to establish domicile in the U.S. along with this form, your husband will need tax transcripts of the past three years.

2. The K-3 route is not feasible anymore. However, you are Canadian and you do not need a visa to come and visit your husband and daughter in july and spend a few months with them,but, you must be able to prove strong ties to Canada when you try to cross the border

Good advice!

1. About the tax transcripts...As we've been here for 14 years, and he's been working and paying taxes here, he's not filed in the US since he's been here. We did, however, discover recently that he should have been filing and that the US gov is saying it's sufficient for USC abroad to file for last 3 (or 5?) years. Anyhow, we've had that on our plate too.

2. Yes, I've learned about the K-3 not being a good option anymore. I'm sure that it'll all work out at the border if I need to cross without the process being complete yet. I figure if I'm prepared and have my good intentions at hand, it'll all be fine!

:thumbs: very big chance. some popel are now being approved in 2-3months. so say you apply now and get approved latest march april, within april may you shd be done with NVC if no RFE and all your paperwork is good and ready to go...then interview june/july.

Aren't you the positive one!! I love it! Honestly, I'm not stressing much about this. I know that it'll happen in good time. It's just a lot of hoops to jump through with the paperwork, but it'll get done.

I do think ahead to the border crossing, if all's not completed, and wonder about the customs agent that I'll happen across. I've crossed the border over land enough times to know that they are not all the same.

I do like to hear predictions like yours though! My mantra has always been to stay positive, so no worries there.

Let your husband and your daughter move to the United States in July while your case travels from USCIS to NVC and to the consulate. You can "visit" later in July or early in August and stay until you have your interview. Then you travel back to Canada, do the interview, wait for your IR-1, and immigrate formally.

You'll get lots of opinions here but I want to second this one. Without an immigrant visa, you can visit the USA but only your husband and child can "move to" the USA. YOU should not travel with any "household goods" but should travel separately, for a "visit". If you haven't already been spending too much time in the USA, you should be able to wait out the remainder of your IR1 visa process while visiting, then travel to Montreal for your medical and interview. Plan on staying in Canada 10 to 14 days for that trip and make sure there is a Canadian address for the visa and passport to be sent.

Facts are cheap...knowing how to use them is precious...

We did the K-3 from Canada (see timeline for how long it took) I do think we were one of the last ones on here to have the option of it. It was actually kind of weird because about 6 months after I had already moved to the USA with hubby we got the notification stuff for the IR-1 visa in Montreal.
