Hi All,

I got the mail today and had some great news, my green card finally arrived after being approved 14 September.

I also got some terrible news,....

Letters stating that my 2 childrens cases were denied, reason given....

The affudavits of support do not meet the requirements because the sponsor and co-sponsors fail to meet the minimum requirements as indicated from the poverty guidelines.

I cant understand why they have been denied as the affidavids of support from sponsor and co-sponsors were enough when they approved me and the ones i sent with the childrens applications were copies of mine.

It also states that i can not appeal but i can file a motion to have the cases re-opened.

Could someone please advise me how to do this.

I'm in tears and in a state as to what to do next i really need some help.

Ally,

Explain what you mean by "co-sponsors" - do you mean a Joint Sponsor or Household Members?

And what were the income level and household size numbers on the I-864(s)? It's possible that the income level was sufficient to sponsor 1 immigrant (you) but not 3 immigrants?

But first, see an immigration attorney about a motion to re-open.

Ally you know that the sponsor and co-sponsor must both count all their dependents......So if they filled with 3 dependents...They have to provide income for themselves+ 3 dependents+ you + 2children+ your husband= Total 8 people.......So double check or give us the numbers and we can tell you what the income should have been.......USCIS usually won't mess things like that up!!

My husband sponsored us as the main sponsor, he did not earn enough as far as the guidelines went, so his parents joint-sponsored me and my children, his father being the joint sponsor and his mother being the joint sponsors house hold member.

I applied for my childrens AOS the same time as mine so the household size numbers were 4 for my husbands form, myself, 2 children and my husband, and on his parents form they put household size as 5, both parent myself and my 2 children, we checked the income level and it was enough to cover all of us.

To confirm that I understand correctly - the parent's I-864 showed enough income to cover 5 people? More than $29,250?

Ally, I'm with Yodrak. It sounds like a screw up.

You can search VJ, and this group http://britishexpats.com/forum/forumdispla...prune=&f=35 for MTR/Motion to Reopen. There was a user named 'grouchy' at the BE group who wrote out what she did for the MTR.
