Hi

I know what this was stupid but it is done and all I can do is move forward and mitigate the damage. My spouse entered the country on a K1. We were married and filed the AOS application. About two months after filing we started havign problems and I strongly considered divorce. We had a lot of adjustment, compatibility issues and frankly I was very scared about signing the I864 when I thought my marriage was in trouble. I was very stressed and panicked (somewhat) from visiting this site too much and really stressing about being financially responsible for someone for 10 years when I wasnt sure my marriage would last a quarter of that time. Anyhow I wrote a letter to local USCIS office and told them I was planning to divorce and wanted to withrdaw my I864. I actually filed for divorce but withdrew/dismissed it. I think stress was a major factor and bottom line when push came to shove I realized we had gone through to much to be together and I shouldnt give up so easily. Also I honestly was looking at marriage to lightly and for long time just kept thinking I will just end it ...wrong attitude.

In my letter I told them that I underestimated the cultural and age differences and that we both were having adjustment issues. I think we both became stressed and very depressed for different reasons. I am older and probably more set in my ways and didn't know we had so many cultural difference until living together. Not things like housekeeping but just how we view and approach things. Also sitting at home too long took a toll on my spouse.

Last we have had some domestic issues and the police have been to the home when things got out of hand. No one was charged and they just made us seperate etc. I know USCIS could probably get this information but is it likely. No VAWA situation here just arguments that have gotten out of hand. We have both agreed this can't happen any longer and have stuck by that.

Okay so long story short we are working on the marriage and due to start counseling. We are working through our problems better and learning to cut each other slack.

We received letter from USCIS that we have an interview. I think the local office interviews everyone but I am sure we would have gotten one becuase of my letter anyhow. When I visited the local office two of the counter people told me this happens all the time. I am hoping that is the case but I KNOW we have to be PREPARED.

My questions here:

1. Do you think I have done a lot of damage

2. Should I get an attorney to go with us

3. Has anyone ever been in this situation with considering divorce and notifying USCIS and changing mind?? (MY MOST IMPORTANT QUESTION)

4. Those of you that have had interiews (even without the divorce issue). What was it like.

5. How personal do you think USCIS will get? There job really is to figure out if marriage is legitimate not if the marriage will last right???

wow, man.. you are mess... I think you should get counseling. If you don't want to be financially responsible for your spouse and fight to the point when a police get involved, this marriage sucks... sorry for both of you, and I hope it will work out, but if it doesn't don't even go further with your application. Regarding an interview experience, mine was great, but some people had issues. My advice is go to an immigration lawyer and tell your situation. Just be prepare for anything...

Try counselling indeed.

Did you receive a confirmation that they had received your letter, or have you called to inquire about the status of the case? If you got the interview letter after you sent the withdrawl, it's possible that the letter never made it to USCIS, or they didn't match the case and the letter together. In such case, continue preparing for your interview. But make sure that you know the status of the case. If both of you don't show up for interview, then the AOS is automatically denied.

No, not everyone gets an interview, and if USCIS has aknowledged the letter of withdrawel I864, it would most likely not result in an interview.

It's fine to have problems. I think most couples have. If you've been married and living together since your spouse arrived, then work on that.

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)
