"If you did not have to file a tax return, attach a written explanation and a copy of the IRS publication showing that you were not obliged to file." I was preparing my AOS and I didn't file taxes ever cuz I'm unemployed and I was wondering what is the IRS publication that shows no obligation and where can I find it, I mean link to it cuz I tried to find it but didn't manage to, and If I have to include it with the written explanation or just the letter is enough?

I am in the same situation and I already sent my AOS and they accepted it,if they need explanation they might just ask on the interview date,or they wont.

I see where it says this on the I-864 checklist...put it doesn't say it on the I-864 instruction form (pdf) you download. So, I didn't submit an IRS publication...and I don't thank many have. Just a written explanation should be fine. But if you want to be safe, this is what it says to do on the DOS website:

IF you paid U.S. income taxes, you MUST submit a copy of the most recent federal income tax return with all supporting schedules and/or W-2s, or an Internal Revenue Service (IRS) transcript (even if the sponsor filed electronically). To request IRS-generated transcripts or copies of a tax return, visit the IRS website.

The tax return must have all pages stapled together in the correct order.

If you did not file a tax return, attach a written explanation and a copy of the IRS publication showing the filing exemption. For information on income tax filing requirements, visit the IRS website.

It tells you to go to the IRS website and print a publication that explains why you did not have to file. It's sounds pretty easy. If you go to the IRS website, you'll find a list of pdf publications. You need to find one that proves you were not required to file taxes. I already found one for you. So print this pdf and send it in just in case they are doing things differently now. When you print it, highlight the area that says "who should file?" and highlight the requirements. Then in your written explanation, explain why you do not have to file according to the IRS's list of requirements.
