Hello everyone. I am petitioning I-130 for my wife. We married on November 18th 2012. Question D2 on the I-130 petition asks "have you ever petitioned for this or any other relative in the past". I'm not sure if I need to check the "yes" or "no" box. Before we became married I petitioned a fiance visa I-129f which required a RFE because we had not seen each other in person prior to the petition. We decided to not go forward with the I-129 and Request for more evidence (RFE), and let the 30 day reply period expire. A few months later we married in Ankara Turkey. SO my question is do I check the "yes" or "no" box on question D2 on form I-130.

"yes", because you did petition for a fiance, even though it was never approved. You can explain the circumstances in the cover letter.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
