hallo there, i am filling N400 based on 3 years marrige.

i dont have joint tax returns with my housbend. i filed tax sprate, but its says marry filing sparate and his name and s.s.

is that ok, or i am going to have truble with that?

No problem with that. Include your tax transcripts. They show married filing separately and it is totally fine.

It is perfectly okay and wouldn't be any problem whatsoever, trust me, even if your tax returns are filed with the status of 'married filing separately'. Many people file their tax returns despite of happily living together because sometimes it's financially beneficial to file under this status than filing jointly. Senator John Mccain and his wife have filed their tax returns always as-married filing separately. Good luck...

thanks for your respons, and i have another problem that maybe you can help me with.- i got my GC in feb 09, wich mean i didnt work that year, my husbend didnt file jointly or with me that year.

so i have my tax only for the next year-2010

i have 2011

and i dont knew if my interview will be when my 2012 tax return beeing ready.

so i have only 2 years tax.

what do you think?

In our case, would have paid a lot more taxes by filing separately for both federal and state. But if filing separately, have to bring in both returns.

After you get all of your numbers, doesn't take that long to calculate your tax liability for filing either jointly or separately. But even if their was a mild gain in filing separately, would have still filed jointly to make the USCIS happy.

Your spouse doesn't have to work at all to file jointly, then another $3,500 or so exemption you are missing out on. In our case, paid a bundle in tuition cost we could only deduct if filing jointly.
