Hi Guys,

I just moved back to the US after living in the Philippines for about 8 years. I currently employed here in California, and I plan to return to the Philippines, in a couple of months to get married to my Fiance. We are planning to go through the IR-1 route, and I have a couple of concerns.

According to visa journey, one requirement when applying for the IR-1 is the affidavit of support or I-864.

The I-864 is the Affidavit of Support form that requires copies of the petitioners past 3 U.S tax returns (or tax transcripts which are free from the IRS) as well as any bank or financial records available (see the I-864 for exact requirements based on your case).

The problem is, I dont have 3 past Tax returns, since I just arrived. I just started working since October here in California for an IT company. By the time my first tax return comes(in Jan), is it enough to prove that I can support my relative? Or would i need a co-sponsor? What if my co-sponsor is (hoping to be my brother or father) is abroad, deployed for military duty? Can they still be my co-sponsor?

Also, what is needed to establish Domicile? Im pretty much tied here, I live with my brother, have a job, have a bank account here, loands, credit cards, bills, etc. What else do I need?

YOu dont need the last 3 years tax returns most people misread what they ask for you only need the most recent tax return and then the AGI for the last years..and I didnt file taxes 2 out of the 3 years cause I was below the income requirement to do so and my father co sponsored us and I believe the person has to be residing in the states to cosponsor..u just need the tax return for whatever was the last year you did file and the AGI for the other years..ours was done like this and was fine..People have a tendancy to send a whole bunch of extra stuff thats not needed

My father can co-sponsor me, but he is deployed in the Middle east, he is an employee of the Military Sealift Command. Do you think he can still sponsor me? What is that AGI? Sorry not familiar. Thanks for the help. I think we have the same situation.
