RFE_page1.pdf

I'm confused about an RFE my chinese wife received regarding documentation we submitted as her birth certificate. We sent a copy of her household registry (houkou) which I now realize is insufficient evidence. She is in the U.S. but we were able to get a (white book) notorial certificate of birth, thanks to her brother in China. In addition to the RFE, USCIS also sent a page of the china reciprocity schedule regarding birth certificates. my confusion comes from the fact the reciprocity schedule states notorial birth certificates are also considered secondary evidence. The attached RFE indicates "In addition to a birth affidavit or secondary evidence....you must submit an original written statement on government letterhead........." Is this really required? where the heck would I get that? I'm worried about not sending in everything they requested and having our case rejected. Should I speak with an immigration attorney?

was there a notarial translation document(chinese into english) made AT ANOTHER OFFICE, or no ?

yes, complete white book along with english translation. All was done at the notorial office in Changsha

Then the 'chinese government letterhead' is inside of that document.

The adjudicator is confused.

Send off another copy of the same thing, with a letter, explaining the contents of the 'white book' .

1. official copy of the chinese document

2. notarial translation of the official original

3. translator's attestation with stamp and signature

OR call the USCIS, get an ISO, explain that the white book IS the official thing issued from the Chinese Government for immigration and overseas purposes, and ask the ISO that a request be put in to the Adjudicator to get a second opinion from a seasoned Adjudicator or that Adjudicator's Boss,

The Adjudicator is wrong to issue an RFE for this document. Their lack of knowledge just caused you some grief.

No Darnell, I haven't sent the notorial document yet. My wife had me believe the hukuo was all that was required for the original filing, so thats what I sent, hense the RFE was issued. I now have the notorial birth certificate but they are also requsting this letter on PRC letterhead...I assume to convey why an original birth certificate is not available.

Complete english translation. The notorial certificate along with english translation was done at the same time. I'm just confused why they are requesting the letter on PRC letterhead if I supply the notorial birth certificate. They should be well aware original birth certificates are not available in China from the 1960's. Did you read the attached copy of the RFE from my origial post?
