Assembling I-130 Petition and VISA Interview of Husband

Hello,

I have been following this forum as it seems the most active and informative.

Right now, I am gathering the necessary documents to include in the I-130 petition for my Indian Husband to live in USA with me.

I have two sets of questions:

1. USCIS recommends how to assemble documents here

Use ACCO fasteners to hold together thick or bulky applications or petitions. Two-hole punching the top of the material for easy placement in the file is appreciated.

a) Does this mean it is ok if I punch two holes on top of the I-130, G-325A and the G-1145?

b) I am also submitting several 8" x 10" photographs of the wedding, should I punch holes in these, or is there a special paper-protector with two holes punched on the top already?

c) And what if I need to use two folders with ACCO fasteners, i.e. one for the documents, and another for the photographs?

2. VISA Interview. When my Husband's VISA interview comes up, will I be allowed to join him in the interview? If so, I need to plan ahead. Right now, I have job, and I want to make sure I have appropriate leave, give advanced notice to my employer so that I still have my job when I return. Can you give your experiences with this?

05/22/2013: NVC gave checklist to send Indian Police Certificate

06/23/2013: FedED'd the IV package with Indian Police Certificate and Updated Passport Page (I was added as Spouse)

07/25/2013: Case Complete

07/31/2013: Received Interview Date for 09/19/2013

09/10/2013: Husband did Medical

09/19/2013: Interview Date for US Embassy in New Delhi - OM SAI RAM - ***APPROVED***

09/26/2013: Husband received Passport with US Visa in postal mail

10/10/2013: Flight Departs New Delhi

10/11/2013: Flight Arrives USA

10/24/2013: Husband received Social Security Card

11/13/2013: Paid $165 Immigration Fee

12/09/2013: Husband received Green Card

With regards to assembling your packet, I didn't punch any holes in any papers of mine. I just paper clipped it all together and mailed it off. For photos, make sure to put the names of everyone in the photos, where the photo was taken, and the date of the photo on the back of each. I only sent in 4"x6" pictures and haven't had any pictures, so I don't think 8"x10" is necessary, but up to you. I placed the photos in a zip lock back then stapled the bag to a sheet of paper, as mentioned in the assembly guides here on VJ.

I'm not sure how the interviews in India work, but for the UK I think the petitioner can attend the interview as long as the embassy is called ahead of time and notified. You may need to look into the requirements for your particular embassy on their site.

In India they do not allow peteioner during interview so your husband has to interview alone. i sent 4x6 photos only and i pasted photos on a printer paper 2 on a page so they were part of packet.

Regarding your entry in Embassy -

If you husband has interview in Delhi, then you can enter normally with him in Embassy.

Regarding pictures -

a number of them has 4-6 pictures of wedding on a sheet and send USCIS couple of sheets that covers the wedding.

You can print pictures on Walgreen, Rite-aid pharmacy..

I have sent about 5 sheet with 6 pictures one each sheet, a total of 30 pictures.

And also, I have numbers the sheet, and pictures and referenced them in cover letter.

e.g.... "I have submitting a affidavit from my wife's cousin brother who was present in the wedding (see tab # 4, picture sheet # 5, picture # 3), he is standing on my left side wearing ....cloths)"

I punched holes in the top of everything (including the forms) and used an acco fastener. my i-130 packet didn´t fit in just 1 acco clip, so I had 3 little stacks (each with an acco clip), and just clipped all 3 together with a giant binder clip. hope that helps.

Good point! I shall identify the people in the photographs, especially if I am submitting an affidavit from them.

I feel maybe I did not send in enough. I sent the notarized letters from his mom, my best friend, the i130, g325a, g 1145, my birth certificate, copy of passport and driver's license, marriage certificate and his divorce certificate and our passport size photos. I am putting together a photo album of pictures for his interview, and other documents...was this wrong? Should I have included them as well?

What ever was submitted was already submitted, but I think it would have been better if you included your beautiful photos.

Now, it is good you are putting together the photo album and anything else for his interview.
