Hey guys. Quick question.

I was wanting to make sure about something, after you get your visa approval, you have 6 months to "activate" the visa then 90 days from that date to get married right? Activation date being the day you leave for the U.S.

I just wanted to make sure because my fiance and I sent out our petition at the beginning of this month, and we found out that his sister is getting married next October. He obviously doesn't want to miss her wedding. I'm just afraid that if we get it too soon he won't be adjusted to permanent resident yet and won't be able to go back home for the wedding.

correct aout having to use the visa to enter the US within 6 months and get married within 90 days after arrival in the US. Once you are married and file for AOS you can also file for Advance Parole (AP) which will allow your fiance to travel abroad before approval of the AOS. The AP can take up to 90 days to process after submission.

Yeah I knew about AP but I was worried about going that route. See my best friend who is going to be my maid of honour is studying abroad in Germany, and won't be back until May. So we can't get married until at least June, that would be cutting it close (if we are even approved by then) to get married and get the AP in time for him to travel.

Good luck with timing everything. Its my least favorite part of this process- to have so much left uncertain because life goes on. Hope it all works out exactly as you plan!

I'm in a situation very similar to yours. We filed back in March hoping to be approved in 4 months tops so we could marry in August, BUT thanks to the IMBRA law this was not possible and to-date we still don't have a wedding date.

My sister is getting married in August next year and I want to be able to come to her wedding, so what we are planning (hoping!) to do is - if we get the visa early next year- to go to a Justice of the peace as soon as I get the visa at CDJ and get married legally to be able to send the papers and get the AP on time for August. After this is done we will start getting everything ready for our church wedding and reception in March/April/May. That way we will be safe to come back for my syster's wedding with the AP, AND also have enough time to have the wedding ceremony and reception we had planned to have prior to the IMBRA fiasco.
