US Born Citizen Wants to Bring Indian Husband to USA

Hello,

I am a US Born Citizen and my Husband is an Indian Citizen. I wish to bring him to the United States so we can start our lives together.

I was reading through the forums, researching the Internet on the process to Immigration Visa for spouse. I want to make sure that all the forms are filled out completely and accurately so that everything goes smoothly.

There are some questions I would like to get cleared before filing the I-130 petition to avoid any roadblocks later on, please help:

Question # 1:

Our traditional Hindu marriage ceremony was completed on September 28, 2012, yet we received the legal Marriage Certificate from Registrar Marriage on October 1, 2012. What does USCIS consider to be the “Date of Present Marriage”?

Question # 2:

On Question # 15 of I-130 it asks, “Name and address of present employer (if any)”. Are they asking about my present employer, or my foreign husband's present employer because question # 15 is listed in the same column as “C. Information about your relative”

Question # 3:

On Question # 17 of I-130 it asks, “List husband/wife and all children of your relative.”. But I am filing the I-130 for my husband, so do I list my husband's name, date of birth, and place of birth here?

Question # 4:

Page 3 of I-130 instructions ask for “Any other relevant documentation to establish that there is an ongoing marital union”. We are including wedding photographs. The question is, what size must the wedding photographs be, and how many wedding photographs should be included?

Question # 5:

On G-325A, it asks for Mother's place of birth. My Mother was born in the early 1940s, before 1947. Prior to 1947, the place she was born was part of India, i.e. Lahore, India, but after 1947, it went to Pakistan, so that place is now Lahore, Pakistan. For Mother's place of birth, shall I put down Lahore, India, because it was India at the time of her birth, or Lahore, Pakistan, because the place is now part of Pakistan?

Answers:

1. What is the date that is printed on your marriage certificate? You may need an India specific answer to this question.
   
2. All questions under section C pertain to the beneficiary.
   
3. You list your name and relevant information for that question as you are his spouse. If he has any children, you would list them there also.
   
4. No specific requirement as to what size a photo needs to be for this purpose; however, it should be big enough for a person looking at it to easily see everyone in it. There is no specific number of how many wedding photographs to include, you include how ever many you feel is necessary to make a compelling case to a USCIS adjudicator and a Consular Official.
   
5. If it was India at that time, then the proper answer is India.

Thank you for clarifying my issues.

Right now, I am trying to assemble all the paperwork for the USCIS based on what they are asking. If they ask for one or more affidavit, I want to provide three signed, and notarized affidavits that state our marriage is genuine.

And of course the wedding photos .... there were nearly 300 of them, but I'd like to send 10 to 15, where it shows we are with our families, and photographs that capture true happiness and cheer.

Such affidavits are not required and they carry little to no weight. If you do decide to include them in your submission, they need to come from people who have interacted with you both as a couple on some level.

I'd like to send 10 to 15, where it shows we are with our families, and photographs that capture true happiness and cheer.

Oh, the affidavits are from people who interacted with both of us as a couple ...... especially one of them had a few good laughs with us during the wedding celebration ......

2. Your meeting with him leading upto marriage?

3. Wedding pictures

4. honeymoon picutres, hotel receipts, plane or rail tickets

5. trips you both have taken to visit family together and provide pictures or evidence.

6. Any thing that proves that you are in married to him. (letters, emails, greeting cards, other things), some of those are very personal...USCIS want to see those.

One of the affidavits will actually mention how we met before marriage, i.e. it was arranged marriage done by elders, then we were introduced :-)
