In april I filed the I130 for my wife who is in india. I have payed the AOS and IV fees but I am confused on how to file the AOS. I have not filed tax returns for the past 3 years because my income was really extremely low. I have 20k in my savings account I don't know how big of a difference that will make. My sister is a registered nurse and she says she can file the i864 as the sponser. She has her 3 years tax returns and job letter ready. However, since I am the primary petitioner do I need to fill out a I864 AOS also? I think the visa application will be denied for my wife until she provides a joint sponser causing further delay. Should my sister file as the sponser? any help would be greatly appreciated..

As the petitioner/sponsor, you must file an I-864. You will need to provide a statement that you were not required to file federal tax returns because you did not meet the income required to file.

Your sister can file a separate I-864 as a Joint Sponsor.

how do I make that statement? do I include both i864 forms in the same packet I will send the nvc? ... & thank you so much for helping me I really miss my wife

You'll need to write a letter detailing your payments over the last few years and include copies of any pay-stubs or W-2's you have.

Just to be clear, you haven't atleast filed even if you didn't have to PAY taxes? Or did you make under the federal and state level to file?
