hi all!

if I add my income to his we will exceed the 125% poverty level. I have been working for almost 5 months and been here in US for 6 months. when we submitted the application we include my employment letter & I-94 card. I forgot to send Emplyment authorization card and pay stub. i didnt file a separate I-1864A but i included my estimated income in a yr as his wife.

please give advise on how to properly do things. the RFE says that imnot eligiable to work but i am just didnt send EAD card to them. Do i need to fill out I-1864A? Do i have to submit w2 and income tax return (which I dont have yet)?

If you don't have an EAD how are you able to work?

As Kezzie said, a co-sponsor is the way to go for the income shortfall.

I have an Employment Authorization card so I'm authorized to work my mistake was i forgot to send them a copy of my employment authorization card so they said i wasnt authorized to work.

as much as possible i want to use our own income and not have a co-sponsor coz we tried approaching people but they refuse due to lack of knowledge about sponsorship.

just want to know if i can use my own income even without my w2 or tax documents but i have employment letter and pay stubs.

thanks

Send a copy of the EAD and recent paystubs.

There's a strict requirement that your employment must be legal for it to be counted. The onus is on the petitioner to prove that legality.

I would send copies of what you previously sent, along with copies of the EAD and recent paystubs, with a cover letter itemizing each and their purpose.

I do not believe you need a co-sponsor.

Do not re-invent the wheel.

IS your work legal, and has been all along?

You need to give them what they ask for: proof that your work is legal. Send the evidence they need.

If it was not, post back.

Spouses do not need an I-864A; see the form instructions for household income.

Please everyone: 'get a cosponsor' is not a default answer. It's easier to give then what they ask for that you forgot to send the first time.
