the last time i saw my fiance was on january 2004 .... he lost his job and he is living from paycheck to paycheck last year, only now that he is starting to build up his account and he doesnt have enough vacation credits to comeback, do you think it will affect (deny) our K1 application?

oops edited my response after seeing your timeline. When you filed you did meet the 2 year requirement right? so it should have no bearing on the NOA2. But you have been waiting a long time.

He sent back the RFE with attached letter explaining why he wasnt able to comeback.. but still, i think im going to start loosing hope.

Fiance and I are having relationship problems, he is getting tired of waiting and the only thing that holding to him to me.. are the k1 papers. if its denied... were over also

This process can have a toll on the best of relationships. **hugs**

I can understand loosing hope because for some one with a timeline like yours it is nothing less than a rollercoaster ride for the emotions. Hang in there. Things ave a way of working out for the best...even if we don't know what the best is when it happens.

For better or worse, you do need to have been in the same place, at the same time within the past two years. So until he can visit you, or you him, you will not be able to file for K-1. As I read your timeline, he filed just past that set in stone rule.

Really sorry, hope you can work something out. I would think the only real solution would be him visiting again and re-applying.

It looks like you just missed the two year prior to filing requirement. if the petition was going to be denied because of it, would think it would have been done by now. hope things work out for you and your not kept waiting much longer.

I think you missed the 2 year requirement and USCIS will not issue the NOA2 (approval).
