Hello,

I have a question concerning the best way to go about marrying my fiance from Germany. The problem lies in that wish to get married next summer (2013), however she would still have a year of University left after that back in Germany. This from what I know cuts out the K1 Fiance Visa route since she would need to stay in the US during the change of status to a permeant resident. Would it be better to just get married over in Germany and then apply for the CR-1 visa?

Thanks for any help on this, I've called and talked to USCIS without being able to learn much.

Yes, a spousal visa makes more sense in your case- she'll get a greencard upon entry and can travel and work right away, plus it's cheaper. The couple of months longer it takes to process won't matter in your case, and she can visit you on the visa waiver program during the processs.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
