Hi Everyone, I'm new using the forums and I've seen that you can get a lot of helpful information. Here's my case, I got married in February 2011, I got my conditioned green card on August 2011. Now, My wife and I are getting a divorce. It just didn't work out, we tried and tried but it didn't work out. We just split our joint's bank account. We're trying to do everything correctly. Yesterday I went to the courthouse to get the divorce packet. I do want to keep my residence here. I've a lot of documentation and pictures that proves we entered the marriage in good faith. Should I be scared about it? Do you think it'd be helpful if my soon to be ex wife writes a letter stating that we entered the marriage in good faith and things just didn't work out between us? What are the steps I have to follow after getting the divorce certificate? Thank you so much for your help!

My friend is going through the same thing and I posted a similiar question yesterday. From my understand you can file ROC on your own. Just make sure that the divorce is final and file immediately after its finalize. Do not wait for the 90 days window to submit I-751. Also you need to have proof that your marriage was entered in good faith so you might wanna keep copies of things you acquire jointly. It would even be better if both of you file joint tax return, joint bank account, joint apt lease or mortgage, loan, credit card, life ins, health ins, auto ins and the list goes on...

Thank you for your responses, I really appreciate it. Do you think it'd matter if I am the one who's filling for divorce? I'm living in Miami, she used to live here but she went back to her home place in Pennsylvania. So I'm doing all the paperwork since we got married here. Do you think it'd make a difference before the USCIS's eyes that I am the one who's filling for divorce?

It matters who files for the divorce. This is from a legal stand point for custody and asset control and division - if applicable (possession is nine tenths of the law).
