She would only need I-601 waiver and you as her USC husband would have to prove extreme hardship to yourself in order for the waiver to be approved. Laurel Scott used to have free online chat sessions on Wednesdays I believe so you may want to present your case to her and ask her opinion.

If wife ever claimed to be a USC when she was not, that's the one show stopper - no waiver available for that. Some drug smuggling cases also ineligible. Don't think your wife falls under either one though.

So for right now, get in touch with Laurel Scott for just an overview and in the meantime wait to see what the consul says about your wife's AP. Good luck!

For what reasons would a case be put in AP? I guess I mean to ask, are there any ways to avoid it?

August 2008 - We met (Both living in Egypt)

October 2008 - Moved in together

Sept. 2010 - Engaged (Living together in Cyprus)

June 2011 - Married!

11 July 2012 - I-130 sent to Chicago Lockbox

20 July 2012 - NOA1 Received (via email)

29 July 2012 - NOA2 Received (I-797)

23 Aug 2012 - NVC Case Number assigned and AOS invoice received (via email)

27 Aug 2012 - AOS bill paid and DS-3032 sent via email

5 Oct 2012 - AOS packet sent

20 Nov 2012 - RFE on AOS packet received

16 Dec 2012 - IV bill paid

25 Jan 2013 - IV packet and AOS RFE response sent

22 Feb 2013 - Case Complete

6 March 2013 - Interview date rec'd

10 April 2013 - Medical Scheduled

12 April 2013 - Interview

01 Oct 2013 - Entered US

also that my wife was a minor at the time (13y/o) to be exact when she got the visa, but on her fake birthday she was (15y/o). Do you think they will pardon the matter because she had no knowledge of papers or control over them?

NO. Hindsight is nasty, though.

IF, she had included a letter of attestation about this, with the I-130, she would have been ok (IMO).

Since it's wound through USCIS, NVC, FBI, DHS, etc, it's too late to fix this quickly.

I wish I had other news for you.

At worst, it's a mis-representation and she'll be bar'ed from entering the USA

At Best, the CO will figure out the paperwork mistake started by her parents, and approve the Visa.

Somewhere in the middle, is the filing of a hardship waiver.

So I reading somewhere that the process of the waivers have been centralized, so instead of sending the waiver to her consular. The waiver would be sent to Nebraska? anybody know how long the processing time is in Nebraska? also I read somewhere that if I have to send the waiver to her consular that the waiver would be process in the closes USCIS field office, which would be in Beijing. Does anybody know Beijing's processing time for i-601 waivers? Since our cases is in AP, should I just go ahead and hire a lawyer and start the waiver process? Also have a question about extreme hardship. I'm 23 turning 24 this month when I leave back to the states as soon as I figure out about the end result of her AP or when I have to leave Mongolia which is the end of October, my grandfather who is in a nursing home and is very ill is signing me as his Power of Attorney. I'm going to need to take care of his medical bills that will be in the near future, although he is in a nursing home, I do see him very often and spend time with him. I feed him, shave him, and change his diapers when I'm there, all of this is the nurses job, but I'm his grandson and do take care of him. Is this a good case of extreme hardship? if I leave to live with my wife in Mongolia, it'll be very hard for me to get a well paying job in a country where I do not even speak the language to support my grandfathers' future medical expenses. Nor do I want to be half across the world if something were to happen to my grandfather, I would like to be there and handle the situation as quick as possible.

Here's a quickie thing to do -

call the DoS Hotline (# in my profile, click the girls, study left panel) and inquire for casefile status, asking specifically if it's in administative processing and/or administrative review.

Do that every two days - it may be that the CO will simply approve the visa, and if that's the case, you'll know from the DoS Hotline within a 2 week timeframe (simply call, ask for casefile status) .

What is the difference between administrative process and administrative review?
