What are the consequences of marriage in the foreign country in regards to the I-129F, fiance visa? Would it delay our "be together date" if we were to marry before our child was born? We were not expecting the I-129F process to take so long and now we realize that my boy will be born before she can come. None of my expedite requests were approved, unfortunately. She might have preclampsia and need to be added to my insurance ASAP!

You will have to withdraw the I 129-F and file for the CR-1 Visa. Basically start over and go through the whole process again. The K1 visa is for you to come here and get married. Once you are married you are no longer eligible for that visa.

Due to circumstances beyond our control, we've abandoned this application

We married on Aug 24, 2013 in a small ceremony in MA

We'll be applying for a CR1 / IR1 visa as soon as we are able

You have to be legally free to marry when submitting the petition, during embassy interview and by the time she arrives in the US. If you are no longer legally free to marry at any time in this process, the petition/visa will be denied. You cannot upgrade your petition to cr-1 and save time either - you start over if you marry, firstly by withdrawing the petition and then send the i-130 after the fiancee petition has been withdrawn.

The processing time for the 2 petitions is about the same, meaning if you withdraw your petition now, you're in for a new waiting period. If it's for the health of future wife, please look into your insurance and if it covers anything pre-existing(such as pregnancy) before you jump the gun on getting married/withdrawing the petition.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

AOS process, December 2011 > July 2012

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)

From filing I-129F petition until greencard in hand: 655 days
