Hello, I have a question regarding my case. I am Filipina I was married before to American guy here in the Philippines and we were separated for 6 years and finally last January 2012 he went to the states and filed the divorce. Actually my ex husband now got remarry again to a Filipina just last month here in the Philippines. I met a guy from the US and he came to visit me October last year, so basically I was married when I met my boyfriend but I was separated with my ex husband for so long. On February 3, 2012 my boyfriend filed a petition for fiancé visa to bring me to the US

He submitted all the requirements and including my divorce paper from my previous marriage and after 4 months of waiting USCIS send a mail to my fiancée stated that the fiancée petition was been approved. So after 5 days my fiancée called the NVC to asked about our status case then they said it was still on process, following up, he called a few days later and they said our papers was sent back to USCIS for further review. So my fiancée called the USCIS then they told him to wait for another 120 days. We were wondering what might be going on, as they never told us exactly what’s wrong with our papers. All they said was to wait for 120 days. Were they concerned that we met before I was divorced?, Or maybe because my fiancée kept calling in NVC? Any answer would be greatly appreciated.

Meeting while you were still married is not a problem. My wife and I also met while I was still "legally" married.

Maybe there is an issue with your fiances timing. You say that your ex-husband filed for divorce in Jan. 2012 and that your fiance filed the petition in early Feb. 2012. You also state that "He submitted all the requirements and including my divorce paper from my previous marriage". Are you sure the divorce was final, signed by the judge, and recorded, etc. prior to him submitting the petition? If not, that would be a problem.

I'm not sure if they check the validity of divorce decrees, but if they do, maybe yours was not recorded yet.

The reason I ask is one month, or less than one month, to get a divorce through the courts seems kinda fast.

Just for the record, the divorce between you and your ex-husband had been finalized by the time your fiancé filed the I-129F, right?

Thanks for the reply. The divorced was done in Guam and he actually filed on November 2011 which was then finalized on January 12,2012 which was signed by the judge. When you mean by recorded you mean signed by the judge? Or do I have to do something here in the Philippines about the divorce since there is no divorce in our country? I went to a lawyer here and filed for ‘JUDICIAL CONFIRMATION of FOREIGN DIVORCE’ but until now Im still waiting to be finalized. Also, my ex husband just a few months ago got remarried, would this help us out? I’m so confused at this point and my fiancé is also at a point of panic. Do you think they would care that it wasn’t yet finalized here in our country? would it be considered for them to put red flag? I just don’t know what to do anymore.

Also Should I call again to USCIS even if they said that it would take 120 days. Waiting is taking a toll on me.

It appears the divorce was completed prior to him filing the I-129F petition, so no issues there.

I don't think there is anything you have to do at this point regarding documentation of your divorce in the Philippines. You will definitely have to show this documentation when you go for your interview though.

I don't know anything about the "‘JUDICIAL CONFIRMATION of FOREIGN DIVORCE’" that you mentioned. You should post this same question in the Philippine Forum. I'm sure someone there has had the same issue/question.
