Hi fellow visajourney members,

After following much of the helpful advice from all of you, My wife and I submitted the i-130 petition. Thank you.

Looking ahead to the next step, my wife and I had some questions regarding the I-864 affidavit of support. We noticed that it ask from 3 years of tax returns. If we submitted the form in January or February 2013, does the NVC expect us to have tax returns for 2012? my wife mentioned people posting about RFE asking for tax returns from the previous year even though the deadline to file for tax returns has approached yet. Thank you for any help with this question.

NO,thay know that april 15 is the dead line,but if you file after april 15 then you will need three years tax transcripts,if you want to send two years tax transcripts and one year copy of your recent tax returns along with the w2.s 1099.

Correct but if you submit the I-864 in January, prior to filing the 2012 tax return, it would be a good idea to go ahead and file prior to the actual interview and email a completecopy of the current tax return and a more recent pay stub for your spouse to carry to the interview.

Facts are cheap...knowing how to use them is precious...

kinda sucks you would get an RFE for not submitting the latest year if it only Jan or Feb. Even more so since it is actually an optional item on the I-864.

06/06/2012: Sent I-130 to VSC (as LPR)

06/08/2012: NOA1 (Priority Date)

06/12/2012: Touched

08/20/2012: Mailed VSC request for Upgrade to CR1

08/23/2012: Opened Request with USCIS for Upgrade to CR1

08/27/2012: Got Email confirming upgrade to IR1/CR1

11/13/2012: NOA2

NVC:

11/16/2012: NVC Received (NVC # not ready)

11/19/2012: BOG number/IIN - Gave emails

11/19/2012: Choice of Agent email sent

11/20/2012: AOS bill invoiced

11/20/2012: AOS bill paid shows in process

11/21/2012: AOS package sent

11/21/2012: AOS bill shows PAID

11/21/2012: Choice of Agent email sent (again)

11/21/2012: Choice of Agent email accepted

11/23/2012: IV bill invoiced

11/23/2012: IV bill paid

11/26/2012: IV package sent

11/26/2012: IV bill shows PAID

12/07/2012: AOS accepted

It's a non-issue. I've never seen anybody get an RFE for the most recent prior year tax return when submitting an I-864 in January or February. However, I've seen numerous people be asked to show that tax return in April or later at the actual interview.
