I've been working in Japan for the last 4 years and haven't made enough to HAVE to file taxes. Therefore I will be submitting a 2555 form to the IRS. However, on the I-864 instructions, page 8, 3rd paragraph of article 25 (Federal Income Tax Information), it says I can submit the Japanese tax paper if I claim I was exempt from U.S. taxes. Does this mean I can just send the Japanese paper and not worry about any IRS business? Or do I still need to send in the 2555 and 1040 so I can get the transcript to give to the NVC?

Also, how long does it usually take to receive the transcript at a foreign address, once the IRS has received my forms?

I don't think that'll be necessary. She's not making any money and we have no idea how long it'll be before she works again, even when we finally DO get to the states. I'm filing my returns separately, not jointly, since there's nothing on her side to contribute to tax filing anyway.

Can she get a SSN with a visa? Without giving up her Japanese nationality? She'd like to keep that to get back into Japan easily in case the need arises. If she can't obtain one, then I see the need to file a W-7. But even then, it's not needed ASAP, as far as I understand. Anyway, I just finished a really annoying tax process and want to send it off and be done with it. Thanks for your input and please let me know if there's something I'm overlooking/misunderstanding.

She can get a SSN with her green card in the USA. Once she's in the USA, the is a STAMP done at the POE that validates the VISA to be used as a 1 year I-551 documment, a temporary green card. VISA alone, no - she cannot get ssn with just a visa. She'll need more than that.

re: filing for an ITIN, filing 'married filing jointly' - it's solely to show that you two co-mingle yer finances, is used for bonafide relationship evidence (read the I-130 instructions again).
