I'm almost done preparing for my Adjustment of status. Thanks for VJers who helped me a lot to go through this!

A little help here first:

My husband doesn't meet the 125% income requirement so we decided to combine his mother's income through I-864A since were living in the same house with her.

A few more questions arose, they are the following:

1. My mother-in-law files for taxes jointly with my father-in-law (His income is mainly from Social Security). In I-864A Part 1 No. 10 and No. 11, should we just need to get her income from her W2s and disregarding my father in-law's income?

2. We put household size in I-864 like this:

Petitioner (my husband) - 1

Intending Immigrant (me) - 1

Household Member (mother in law) - 1

----------

Total = 3

Should we count my father's in law as a household member too? I asked her and she said that she doesn't have any dependent on their tax return.

My sister in law (she's 32) also lives in the house, will it affect anything?

3. We already print their tax return from the tax services their using. And I believe that she has complete W2's and schedules. Do they need to both sign it since they file it jointly?

Thanks a lot for every one here to make things clearer and easier. We wouldn't gonna make it from our K1 visa to here without you.

she is not your husband's dependent, she is not on your husband's taxes. each household is separate you and your husband on the i864 and, his mom, dad and you on the i864A, if her dad's income isn't necessary then yes, her mom would need the W2's to establish her own income separate from her husband's

his mother is filing on her own so she will be filing the i864 without any of her husband's information, so no need for her husband to sign the i864A

From what I read before, we thought we have two options here. 1st, mother in law to file her own I-864 and 2nd, MIL file I-864a together with husband's I-864, and we chose the latter. Should she needs to really file I-864?

no, she never counts on his i864 household size.

the two options are, your husband files the i864 and mother in law i864A as household member. they combine incomes

or your husband files a i864 and your mother in law files her own i864 as joint sponsor and her husband the i864A. she cannot combine income with your husband as joint sponsor, but she combines her income with her own husband, as her household member.

the household sizes remain the same, you and your husband, and three for your mother in law.
