I need some advice please.

I have been following USCIS advice online but this is taking so long to complete my case which is now at the NVC. My spouse and I are tired of waiting and just want to be together.

My I-130 and I-129F have been approved, and still at the beginning stage at the NVC.

My question is, I have a valid tourist visa, do I still need to have NVC process my paperwork since the K-3 visas are no longer in effect? I wish I had known this before applying for the K-3. Can I travel to the US and just adjust my status once there? What is the best option here? Can I cancel my NVC case?

Thank you, and I look forward to reading your comments.

Travelling on a tourist visa to the US with intent to stay and adjust is illegal.

Did a lawyer advise the K-3? The best option is the just wait out a CR1.

This you must not do. You can not enter the USA on the tourist visa with the intent of adjusting your status. That is fraud pure and simple. The penalty is a long term ban.

Your case will become a C R 1 which you will find to be a very good way to proceed. Find the flow chart here on V J to see how the case will go forward. The waiting is diffcult but you are well on your way. The best option now is to try to be patient and finish what you started.

Thank you all for your advice. I will wait the process out and continue the legal route. Yes, we were told by a lawyer to file the K-3 application with the I-130.

Now if only NVC can speed up the process.

Thanks again.

This is the correct decision. The K 3 will become a C R 1 which you will find is better in the end anyway.

Find the info here on V J about the NVC steps and you will find a way to get your end done in advance therefore saving you time. If you need help just ask here on V J. The more you know the easier it is to deal with this process.
