Hello all,

My aunt is in process of bringing her fiance over seas with K1 VISA.

She currently has her elderly parents living with her, they recieve social security income every month. The questions is, since they live with

her and she claims them on her annualy tax returns. Does she have to add them as dependents on the affidavit and does she have to mention their

SS income anywhere on the affidavit??

I need some answers ASAP please,because i need to send the paperwork overseas tomorrow.

yes she need to add/count them on the affidavit specially she claim them on her tax just the way it stated on I-864/I-134 affidavit form..

so far i know affidavit of support ONLY asking for her income not her dependent/s....unless its child support. (i'm not 100% sure for this question).

The longer it takes to happen the more you'll appreciate it when it does!

Yes she needs to mention them as they are her dependants, so they count towards household size.

No she doesn't need to mention their income unless they sign a I-864A.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
