Hi fellow journiers, My fiancee interviewed 7 June and it was discovered the daughters father entered a date of marriage on birth certificate (they were never married she showed her CENOMAR and got one for the father showing never married). Apparently everything else went well but the birth certiificate needs to be amended. 3 month process and fees started june 8th. She wil see the trial court judge to finalize the amendment Aug 7th then to the NSO, additional week then mail amended birth certificate to embassy as instructed. They kept childs and fiancee's passports so I assume we are tentatively passed awaiting the amendment.

My question is; can our application expire while awaiting the birth certificate amendment? If so what would we have to reaccomplish? This has been a real kick in the pants for both of us :crying: and we hope after this they wil issue the visas. Thanks for any info on my topic. :help:

06-23-2013 - Ying returns to China to assist with completing son's K2 Visa

07-10-2013 - Ying's son, Zongyang, passes K2 Visa interview in Guangzhou

07-29-2013 - Ying's I-485 AOS is approved

08-03-2013 - Ying's 2 year green card arrives in mail (she's still in China with son)

08-08-2013 - Ying and Zongyang enter US, HK to Toronto to O'Hare

I thought they would receive their visas when the birth certificate process was completed.

If that had been the case, your petition would not have expired. The Embassy would have extended the validity of your petition for up to one year, especially since they see progress being made in your case.

I have a quick question here that may not be related. My fiance has an issue with her birth certificate as well, basically stating she is male rather than female. When you went through the amendment process, were you in the process of filing a judicial order for this? Were you needing to bring anything like an Affidavit of Explanation to show you were modifying your birth certificate in the process? I'm hoping we won't need to wait that extended period of time for the amendment, and just trying to figure out if we can proceed with the interview. Thanks for any information you can provide!
