Hi I sent in my I-129f on the 2nd of July and I was curious how long after I sent it in is my finace not allowed to enter the USA? I'm planning a trip to see him beginning of aug and its so much cheaper if he picks me up in Seattle than yvr Vancouver airport but wasn't sure starting when he wasn't allowed in the states >.<

If your fiance is a Canadian citizen he can enter the U.S at anytime during the process but it is up to the border patrol agent to determine if your fiance has enough ties to Canada to come back to Canada after the stay. To make you feel better, my fiancee has only school verification of enrollment as ties but they let her come in anytime she comes. One agent gave her a hard time after the NOA1. She has come and visited twice after the NOA2 and we have had minimal problems.

So are you saying that he's not like banned from USA by law or anything? It just depends on the border patrols judgment? But when he goes to the border will it say something on the computer saying he's applying for k1 an cant enter? All we want to do is for him to pick me up from airport Togo straight back to Canada...

Oh and he is a Canadian citizen

Right I know I can visit him but I kept reading he wasn't allowed to enter once I apply for I-129f so I just wanted to know exactly how far into the process before he is not allowed. I only sent it in a week ago

As noted in the previously mentioned stickie, it is not a question of when he is not allowed. Rather it is a question of how compelling is the evidence that he presents to the CBP official at the border, that he will return back to his country after the visit.

I went down to the US a couple of times during the application process - the first time being less than a month after our NOA1, and not a question asked. If you want to be safe, you can get them to bring evidence of ties to Canada as mentioned above.

Will the officer know a K1 has been applied for when they scan the passport? Or do they only know if we tell them? Im wondering as we mailed our i-129f off a month ago and i intend to visit at least once a month until i come here permanently. Will have work letter/roster etc and letter off landlady - but do we need to declare our petition on entry?

I'm not sure how much information the custom officer has, but it's possible. They'll ask you why you're visiting, and there is a chance you'll get questioned if you tell them you're visiting your fiance. My only "grilling" was at the Vancouver airport in April, probably because I was nervous about my first connecting flight, but fortunately I didn't need to show any ties. They asked stuff like who was moving and when we were getting married, but never mentioned the K-1 (I think I might have mentioned it though).

Hello, I have a similar question as Simplyynina asked in the thread, however, my fiancee is only a permanent green card holder. My fiancee is currently residing in Canada as a green card holder and she has a US Travel Visa to visit me in the US. My question is, will this in any way affect our I129F submission or status? We are thinking about submitting the entire I129 packet soon and we would like to know. Your help would be greatly appreciated fellow VJ'ers.

Hello,

What it should be say is that it is a grey area why:

Because yre travelling with a tourist visa and yre making a moral promess not to try to immigrate to the usa. Yet y have a file trying to stay in the usa. Whatever it is always at the discreation of the border officer. Y can travel but if the officer has a doubt y will be staying without a proper visa y can be refused. Be honest to the officer when he/she asks y the question and travel with yr return ticket prebooked,It will help. This is true for every country even when a visa is issued.
