Hello Guys,

My brother's interview is on August 3 , and im preparing his paperwork for him on the day of interview. NVC requested only recent taxes on the interview but i thought mind as well to fill a new I864( sponsor which is my mom who is sponsoring him mon) also me as co-sponsor i864A ( i am her daughter). The question is on form I 864 Part2.

13. I THE SPONSOR, _________________________( IT SAYS PRINT NAME)

in consideration of the household member's promise to support the following intending immigrant(s)

and to be jointly and severally liable for any obligations I incur under the affidavit of support, promise

to complete and file an affidavit of support on behalf of the following_____________(indicate name it says to put) named intending

immigrant(s) (see Step-by-Step instructions).

i DONNO WHICH NAME HAS TO BE THERE MY NAME OR mY MOM'S NAME ( SPONSOR) . I assume will be mom's name on part 2 and also what number im supposwd to put where it says indicate the number.

When you fill out form I-864 that is your mom's name because she is the primary sponsor. When you do I-864A that is your name as a co-sponsor. The household numer is how many people is your mom and/or you supporting right now. Hope this helps

I am eligible to complete the I-864EZ.

At section 19 if you check the box you confirm that you submitted the last 3 years tax returns, but only sending them the latest.

In my case I have only been in the USA since 2011, so my only tax return is for fiscal year 2011. At the description section they don't specify this case, however they make a comment that if you were exempt to file a return for any of the previous years, you will need to explain it (i.e. not being a US resident for tax purposes).

Anyone has experience with less than 3 years of tax returns submitting this form and what was the requirement if any, other than just commenting in the cover letter on your situation as not being in the USA long enough to submit 3 returns ?

What does the sponsor do when he/she was not required by law to file an income tax return during a given year?

If you did not have to file a tax return, attach a written explanation and a copy of the instructions from the IRS publication showing you were not obliged to file. For general information on income tax obligations, visit the IRS website.
