Odds are all you will have is copies of the Tax Returns, so yes to that. But you may want to have him include a declaration that states the copies are true and correct copies of the returns filed.

Something along the lines of: "I declare under penalty of perjury of the laws of the United States that the attached documents (list...) are true and correct copies of the originals." - Sign, date and state the city and state where signed.

That may help.

He'll want to get and send you tax transcripts, not the tax returns. He can request them online, by fax or by phone. Although I'd recommend the online or by fax option, they never seem to answer the phone. The tax returns are complex and often require many forms, all of which will be only copies of what he sent in and also require you have the W2's. Tax transcripts from the IRS are their condensed statement of what they received from him.

You can order tax transcripts through the IRS Transcript order line. It's very easy and all automated . Call (800)908-9946 or order online. Very simple and free. Just ordered some recently and had them in 8 days.

06/11/12- Official NOA1 date on hardcopy

06/12/12- USCIS cashed check

06/14/12- Received NOA1 hardcopy in mail

09/09/12- Received Text/Email NOA2

09/12/12- NVC received

09/13/12- NVC issued case #

09/14/12- NVC Left for USEM

09/17/12- Schelduled Interview

09/21/12- USEM Received case

09/21/12- Received Instruction Letter NVC completed

09/24/12- Medical at St Lukes ( Day 1 Delay started menst :( )

10/01/12- Medical at St Lukes (Day 2 Passed)

10/04/12- CFO seminar completed ( Certificate issued)

10/19/12- Interview USEM (Approved)

10/24/12- USEM issued/released visa to 2GO for delivery

10/25/12- Able to track visa via 2GO website ( *Had to use UID# as tracking #)

10/27/12- Visa received (Quezon City)

12/06/12- POE SFO

So what you guys are saying is that the USEM actually prefers the Tax Transcript to the actual return ??

I haven't checked what the USEM says about CR-1'ers/IR-1'ers. However, the USEM calls only for tax returns from K-1'ers.

Most K-1'ers submit only tax returns. Some K-1'ers submit only tax transcripts. I submitted both.

There have been cases here on VJ where tax transcripts were submitted and the USEM then required tax returns to be submitted.

Tax Transcripts are preferred and there has never been a case of anyone being delayed for having a tax transcript, if the actual tax return would qualify them. As the OP said, the actual return can have many parts and forms and the Transcript is an actual condensed form.

That sounds a bit backwards while more and more people don't even use forms any longer, but file electronically. Even the IRS is working to get everyone to go paperless.

I made copies of 2010 and 2011 tax returns and thats what were going with. I will have the fancy original's with if they want to see them. In addition, letter from work, paystubs, W2's, website they can verify my work/pay, copy of my benefits and thats it. No bank statements or copies of 401k ect.. Hope its enough..

27 January 2012: Mailed I-129F

03 February 2012: NOA1( e-mail & Text)

03 February 2012: Check Cashed

NO RFE'S

22 June 2012 : NOA2 (e-mail & Text)

16 July 2012: Manila Case Number(by phone)

17 July 2012: Interview paid at BPI

19 July 2012: Set interview for Mid-Aug

23-24 July 2012: Medical St. Lukes(passed)

24 July 2012: CFO Seminar(had to go next morning for landline #)- PASSED

02 Aug 2012: Received e-mail from USEM our case is there.

15 Aug 2012: Interview at USEM - APPROVED

13 SEP 2012: POE Minneapolis, MN

27 OCT 2012: Married

19 NOV 2012: AOS package sent

05 DEC 2012: NOA's I-765, I-131, I-485

Please provide the link showing that tax transcripts are preferred.

Using your logic, if someone was delayed because they used transcripts instead of returns, wouldn't it have been wise to follow directions and submit a return in the first place? By the way, weren't you the one who was whining about efficiency in the St. Lukes thread? Now you're recommending the opposite. :blink:

I used only the transcripts and everything worked fine, no W2's required. Anyone can fill out a tax form with anything on it, doesn't mean that is what was actually turned in to the IRS. Although lying by turning in a false tax return form could lead to very bad problems.

Your right. Like I said there has never been a case ever recorded someone was turned down for using a tax transcript. In fact most use them. How anyone could tell me that they might not accept a tax transcript then brag that that they turned in both to be safe defies logic and reason.

This whole little debate started because someone said they were turned down for using a tax transcript in 2010. Upon digging it was discovered that the 2010 tax transcript did not meet basic income requirements and they had to hurry and file the 2011 and send it in, because they did meet requirements on it. Obviously they could not send the 2011 transcript because they had just filed the return. Tahoma also does not think you can make your appointment as soon as the NVC gives you your MNL and that you have to wait on your package to reach Manila.

On the flip side I made the mistake of calling him out when he said St. Lukes did not take appointments. After careful research he was correct, it is all walk in's but you can per-register.

Anyway it's more in fun than anything on my part, I just want to make sure people have the best info to guide them the process effortlessly.

I just called the phone number you guys supplied for the IRS transcripts, if that wasn't the easiest thing to do so far. 5-10 days and will be here. Might as well have those and returns just in case. Thanks for the great info.
