Canadian on H1B but no I94

Timeline

Hi Everybody,

I am a canadian citizen who just married to USC. I am planning on

filing I130 and I485 (and all other forms.) I am currently on H1B.

However, last time when I exited US to go to Canada, the airline agent

surrendered my I 94. On the way back, the immigration officer said

Canadian citizen don't need I-94. Then I exited US again without I-94,

coming back with no problems. But now, I realize some forms require a

copy of I 94. What should I do? Should I exit the country again and

REQUEST a I-94 form on my passport? Or they can process my form without

I-94? :(

No one really wants to touch this post since it tends to be a touchy subject. The methods most are familiar with are, K-1, K-3, CR-1, DFS. But AOS from another type of visa can get messy and complicated.

I read the URL. I have been staying in US since 2000 and just got married recently. I talked to one consulate office who said if I enter US using H1B, I don't necessary need I94. I think I will need to talk to a lawyer for this. The problem is from the immigration officer, sounded like this is a new law. And they did not put I-94 form on my passport twice. So confusing......

Good luck, if you have been in the states that long you should have no problems doing the AOS, but what you say about asking a lawyer is a smart thing to do.
