So I am planning on consulting an immigration lawyer this weekend in regards to our situation, but then I found this awesome site of yours so I thought I'd ask here first hoping someone could share some knowledge my way :) again our situation is this, I am about to file a K1 visa for my fiancee in the Philippines, as she was filling out her G325a she came across the part requiring her to list her place of residence for the past 5 years. Since her current address is in Jeddah Saudi Arabia, we started wondering if her living outside of the Philippines during the filing process would cause any problems? I am hoping that someone well versed with immigration laws or someone who has gone through a similar situation will be able to help answer our question. Thanks in advance and I look forward to seeing you guys around.. cos I'll probably be here often for the next 5 or so months :)

There is no problem on that..she just fill up the form honestly and truthfully because later on she will secure a police certificate of all the countries she lived in the past years. As long as she is legally work in Jeddah,there is no need to hire a lawyer.She can apply in the US embassy in jeddah.I am a filipina too,i worked in hongkong then work in Canada now. The US embassy in Vancouver just requested a valid work permit to prove that i live legally in Canada then provide the police certificate in the countries i lived in previous years. She might do slightly the same i guess. Just follow all the instruction with the help of this website and you two will be fine. Goodluck!

ok I don't know if this can answer your question, a friend of mine works in Qatar, they filed the i-129f while she's in Qatar, she wanted to have the interview here in the Philippines so she went back here in the Philippines BUT nvc sent their case to Qatar since her current address when they filed the petition was in Qatar, even they changed the address in uscis NVC didn't change it. so they had to do a request to transfer their case here in Manila USEM. it took them almost 3 months before USEM receive their case after that she receive an email from usem here then she continued her visa process and now already in US :)

yes I agree with you if she wants to have her interview there in Jeddah she can, and they said it is faster to do it in the other country instead here in the Philippines but for me it depends on the case :)

On the form they ask where your fiance will go for her interview, she can go to the embassy in Saudi Arabia or in the Philippines as she thinks would be easy for her.

She should check which countries offer Police Certiicates. Some of the middle east countries, like Kuwait, will not give them to people who have already moved out of the country. Here is what it says about Saudi Arabia. Note that they do not give Police Reports to non-Saudis who have already left the country. This is the same for Kuwait. SOOOOOO if you happen to move back to Philippines and process your application from there, the US Embassy will not require a police report from Saudi Arabia, because you cannot obtain it. However, if you are processing in Saudi Arabia, you'll need to get it it sounds like:

Police Records

Police clearances are available for Saudi citizens and resident third country nationals. Saudi citizens currently residing overseas must return in person to process the police clearance.

Saudi citizens and third country nationals residing in the Kingdom process the police clearances by first obtaining a police clearance request letter from U.S. Embassy Riyadh, U.S. Consulate General Jeddah, or U.S. Consulate General Dhahran. This police clearance request letter, signed by a consular officer, must be attested by the Saudi Ministry of Affairs (current fee is SR30). The applicant must then appear personally with a passport-sized photograph and a national ID or residency permit at the regional Criminal Investigation Department for fingerprinting. Fingerprinting for women is done in a separate room. The police clearance should be available for collection after a week or two.

Police clearances are available for Saudi nationals residing outside of the Kingdom. The expatriate Saudi citizen obtains the police clearance by returning to the Kingdom and obtaining a police clearance request letter from U.S. Embassy Riyadh, U.S. Consulate General Jeddah, or U.S. Consulate General Dhahran. Just want to make clear, because this was a huge point of stress when we filed our K1, you need to check, many countries will not issue police reports to non-nationals. In those cases, you will not be required to obtain one. My fiance lived and worked in Thailand and Kuwait, but was back living in the Philippines when we got engaged. Thailand police report was available, so we had to get it (it was a pain). But the Kuwait one is not given to non-nationals. So I was stressed for months, trying to find out how we could get it, because no one here or anywhere else just said 'not needed'. It took me months, consulting lawyers (they all had NO clue about it, just said to go the Kuwait embassy, who said no way, you can't have it). So here I am stressing forever thinking this is going to prevent our Visa. FINALLY I get someone at the US Embassy who states 'oh we know you can't get it from Kuwait, so don't worry about it, we won't ask for it, but you'll need the one from Thailand'.

Phew.

So my point is, according to the rules listed for Saudi, if you fiance leaves Saudi Arabia, she will no longer be able to get the Police Report. Which might make things easier.

Of course, maybe not a bad idea to get it while she's is there either way, if it's not too hard.

No, it is not a problem. If your fiancee is not in the Phillipines she will have her interview where she currently resides. You do not need a lawyer for this issue.

Wow, thank you to all who took the time to reply to my posting. I was thinking that i would get one or two replies but you guys are awesome! You guys just saved me hundreds of dollars in lawyer consultation. I'm learning so much from this site about the petitioning process. In fact though one issue has been resolved (re: my fiancee working in another country), we are finding other concerns that we were not aware of before. More specifically Police Reports!

My fiancee, before working in Jeddah, also worked in Jordan for two years. Unfortunately, she was not able to acquire (nor did she have any reason to) a police report before exiting Jordan. After doing some searching on this site and on the internet, I've found that Jordan does give police reports but it is such a pain to acquire one. From my initial research, the only way to get a PC was by going back to Jordan in person! Thankfully, after a little more research, i've learned that this can actually be done at any Jordan embassy.. in my fiancee's case, the Jordan embassy in Jeddah. I am having her go there to inquire about her police certificate but they are closed til saturday... which means i will be a nervous wreck until friday my time :blink: Has anyone else here have any experience with Jordan police reports?

I almost forgot, one more issue that has come up! I hope you guys don't mind me posting so much stuff.. my mind is being bombarded by a thousand things right now and all of it related to K1 Visa hehe. Anyhow, so we've decided that she will be taking her interview in the Philippines rather than in Jeddah, our worry now is the timing. Her contract in Jeddah ends in December, which means she wont be in the philippines physically til late December. If i were to file my petition by the end of this month or beginning of July, IIRC at this time processing time is around 5 months, what if the Philippine embassy sends the checklist and forms to her Philippine address before she comes home from Jeddah? What is the grace period for her to reply back/contact the embassy?

I am probably stressing myself out more than i should.. but any input is appreciated. Thanks so much! :)

With the timeline(s) you are suggesting I would say you should have everything sent to her in the Philippines. She will not have to do anything (except the initial petition stuff) until approx 5-6 months after you send the petition.

But just for my peace of mind, i was wondering, after the embassy contacts/sends the forms and checklist to the benificiary how much time does she have to complete the forms and send it back to the consulate? My worry is my fiancee is scheduled to fly back to the Philippines Dec. 30, what if the forms/checklists were sent to her home address say a few weeks earlier? Does the embassy issue a due date for returning all documents and forms? Again i apologize for being so nitpicky, i just want to do everything right the first time.. i'm sure you all can relate. Thanks again! :)

I know you do have a certain time to do it, I cannot remember the exact time, I think it is 90 days or 6 months but I really cannot remember- sorry I am not much help on that one, I am SURE someone knows though.

Yes, in theory filing in July would be perfect as far as timing. But since my fiancee will be coming from a country like Saudi Arabia (i've heard horror stories of foreign workers that encounter all kinds of difficulty and delay just trying to exit this country), i would rather be prepared for the worst case scenario. Thanks so much for your replies though, they really are great help :)
