AOS question please help!!

Timeline

my wife and i are filling out AOS forms and what i'm concern about is that my wife worked after her I-94 expiration date. the story is.. my wife came here on a K-1 visa on 4/11/06 and her I-94 expires on 7/11/06. we got married, got her SS # and card. at the ss office i asked the worker there if my wife is able to work after receiving the ss card. he said yes she's able to work. he reassured us that everything will be ok. so she looked for a job and finally got one on aug 03 (after her I-94 expiration date). but she only work there only 1 week and quit. afterwards i looked at her ss card more carefully and noticed on it that it says "valid for work only with dhs authorization". i panicked. was that illegal what she did? is this going to affect her applying for AOS? what should i put on her G-325A on the job listing section? should i even report it? any advice will be greatly appreciated. thanks!

Don't worry about it. She is not working now so there is no reason to put anything on the G325A. Of course she is not supposed to work until she gets the EAD but this is not something that they hunt down. We have been all the way through the interview and green card. We were never asked about work.

20 April 06 Touched on all applications

21 April Email received EAD approved

27 Apr Received EAD card

30 May 2006 Received appointment letter for JaX on 13 July 2006

13 July Interview successful approved

20 July Received green card

30 June 08 Sent I751 to remove conditions

25 July 08 Application returned erroneously incorrect fee

27 July mailed new application with separate checks

15 Sept 08 Application returned erroneously K2 not within 90 day timeframe

17 Sept Mailed 3rd application with mountains of proof of error copied Senator Mel Martinez

09 October 4th application package sent. This time they said the app signature page was a copy

10 Oct Sent package again 4th time.

25 Oct Received another NOA for Wife with $625 for the amount with one year extension

30 Oct 2008 Still nothing for step daughter. Checks still haven't cleared the bank

24 November Checks finally cleared the bank

February biometrics for wife Nothing for daughter.

I find it very hard to believe you didn't look at her SS card and see the stamp on it, or that an employer didn't ask to see it. You should have already filed for AOS before the I-94 expired as well. You are now 3 months out of status. You have more problems to worry about than your wife working illegally. The only advice that should, and can be given, is don't lie on any form you fill out. You may want to consider contacting an immigration lawyer.

roi aggie,

i live in tx and there is no stamp on her ss card. i mentioned that i asked the ss clerk while he was preparing for her ss #, that if she's able to work and he assured me that she can. this is even before she received the card!! we are both very naive and ignorant about all of this. and we both can't help that her old employer didn't know about the situation either. i thought this site is a great place for info and advices not for someone like you to doubt me and place blame when i have no idea...

and i thought you can file for AOS after the I-94 expires, as long as you get marry within the 3 months before the I-94 expires??!!

You are correct about the marriage within 90 days. For many people there is simply not time to file for adjustment within 90 days, especially if you want some type of wedding. People here have gone very much farther than you before they filed for adjustment.

I looked again at the G325a. It has been a while and I did not realize that the questions were about employment history. I was thinking they were about current employment. I think if I were you I would probably list the job and the dates and be prepared to answer. My guess is you will never hear any more about it. If I am wrong you may have to explain the story that you told here. It is an honest mistake. I found the people at the interview to be quite pleasant. I think they would understand. This process is very confusing.

Roi Aggie seemd a little on edge in the answer for you. This seemed to be a touchy subject for some reason. Talking to a lawyer is always the safest response here but most of us are here because we have chosen to do this with the help of our VJ brothers and sisters. Perhaps you will get some more advice. I really don't want to be the only one here.
