Hi, I am filling out I-864 and I am kind off stuck, so here is the deal: I am the petitioner and my husband is the immigrant, I have been unemployed for the past few years. My brother will be the sponsor, I am currently living with my brother and he has been claiming me as a dependent on his taxes for the past few years. So my question is would my brother have to fill out an I-864 or I-864A?

My second question is about the I-864 that I have to fill out...

1) part 3 question 8: I am sponsoring the principle immigrant named in part 2 above: yes?

2) part 3 question 10: the total number of immigrants I ma sponsoring would be 1 even though I am not really sponsoring him and my brother is?

3) part 4: for the information on the sponsor: would that be my information ?

I guess what I am confused about is for the I-864 that I have to fill out would I put my information on it even though I am not sponsoring my husband and I am using a joint sponsor?

Can someone please help? Any kind off help is really appreciated!!!

1. Yes you are still the main sponsor even if your income is zero.

2. Yes

3. Yes that would be your information also

Your brother needs to fill out another I-864 to go with your I-864

Another option..

Your brother can fill out I-864a instead because he is a household member. ( you still need to fill out your I-864)

if he does this, need proof that you live together.

But in my opinion since it sounds like you will be using his income solely, it is cleaner/ simpler for him to do the I-864 (again, you still need to file one as well as the main sponsor)

Ps: since he claims you as dependent, he needs to count you in his household count

I have few more concerns, during college I worked a few hours per week at a pharmacy up to 2010 and in 2011 I was unemployed, I never had to file taxes since it was not enough at all, so on I-864 for part 25. federal income tax return information do I just enter 0 for my total income as reported on my federal tax returns for the past three years? Also, what kind of evidence do I have to submit to prove I was not making enough money to file a federal tax return...

As for the documents my brother(joint sponsor) has to submit with I-864:

1. proof of citizenship

2. I-864 form

3. copy of federal income tax return for the past three years

4. copy of each form w2 & form 1099 that relates to the returns for the past three years

5. IRS transcripts for the past year

6. evidence of income : pay stubs for the past 6 months + employment letter

Is that it or is there something I am missing?

Again, thank you so much for the help!!! I am just trying to finalize everything before submitting :)

You will also need something to show how you are related. Like both of your birth certificates showing you both have at least 1 parent in common. You have to establish your relationship to each other. They may have an issue with the tax returns because it doesn't sound like you can be claimed as a dependent (Married/over 18).

If you had any money taken out for federal you need to claim it. Remember, they can check and see. If you didn't file because you didn't make enough then you need to include a letter with your affidavit of support stating you have no tax returns because you either didn't have income during those years or because you didn't have to file taxes. Provide any paystubs or a final receipt from unemployment, etc showing what your YTD (year to date)is. Remember, USCIS loves docoments so the more the better. When I submitted mine I not only did so with birth certificates establishing relationships with household members but copy of tax bill for residence to establish home value, etc and it took less than 2 weeks to get an approval.

Unemployed for 3 years and living with your brother? I really wish there were more financial restrictions placed on the petitioner.
