Hello every one !

I have a little confusion about what to do - please help me !

In January, i filed the form I-130 petition for my father.

Him and my mom are divorced. My mom lives in US right now, married to another man.

I sent them marriage certificate (with the date) and divorce certificate (with the date), which showed that i was born when they were married

I also sent them my birth certificate which was registered a couple of weeks after i was born. It clearly shows my father's and mother's name and place, country, town, where i was born.

I also sent them my liable copy of name change. (When i had naturalization for citizenship, i changed my name).

So i received the attached letter a couple of days ago.

It is the Request for Evidence (I-797E)

With that said, I understand that these two pages do not apply to me, because i sent them all the documents i was supposed to, and they were word-for-word English translated by a certified translator.

Do they want me to send all those documents AGAIN???? Or am i not understanding their request correctly?

Any given advice would be much appreciated.

Ok, so i just read the letter again. On second page it states:

"The petitioner is seeking to establish a qualifying relationship based on a father/child relationship. It is not clear if the BENEFICIARY was born in wedlock"

Beneficiary is my dad. Since i am a son (petitioner), filing a petition for my father (Beneficiary). Do why in the world do they need to know if HE was born in wedlock?

Then they state:

"For immigration purposes, the term "born in wedlock" means that a child's natural parents were legally married at the time the child was born. If the BENEFICIARY was born in wedlock, submit the marriage certificate for the PETITIONER'S natural parents."

How should i comprehend this sentence? The need my father's parent's marriage certificate for MY natural parents???? What is this?

Submit as much as requested documents included those you already submitted. They want to see father/son relationship over the extended period of time especially when you were minor(under 18 years old.) The supporting documents was mentioned in the Request for Evidence (I-797E). You just need to find out what documents existed and submit them before the due date. Examples of documents that I can think of are your birth Certificate showed your father's name, household registrations showed you and your father had resided at the same address, school records listed your father as a financial supporter, old photos taken with your father since you were young till the most recent, etc. Hope this helps!!!

Ok, in the letter it says: "If a civilly-registered birth document for Alex......is submitted that shows that the birth was registered ONE year or more after the birth, the petitioner must submit secondary evidence to establish the claimed relationship."

Secondary evidence is what you listed: "household registrations showed you and your father had resided at the same address, school records listed your father as a financial supporter, old photos taken with your father since you were young till the most recent"

But this is if my birth certificate is DELAYED. And mine is not delayed, it was issued a couple of weeks after i was born. Do you still suggest to send them photos and other things even if my certificate is not DELAYED??

I don't see any problem of your birth certificate since it was registered near your date of birth. It said if it was registered one year or more. In you case the only birth certificate you will submit is the one that you already did.

No, you still have to send the requested documents. It is very important that you submit them to show the relationship of you and your father and I gave the example of documents. Talk to your father and/ or your mother if they have any such documents or pictures. The birth certificate is not enough!!!
