Hi there, I'm new, don't mind my incredible lack of knowledge on terms regarding visas please.

I know that a person from Canada can go to the USA without a Visa for up to 6 months. I believe it's called "vacation time" or something along those lines.

Anyway, I wish to marry someone from the USA. Do I need a fiance (K-1) visa in order to marry him, or can I marry him as long as I'm their legally for less than 6 months?

Once we are married we will apply for my permanent residence there but I'm curious as to if I need this K-1 visa or not just to go there and marry him.

I will be going back to Canada after the marriage so I will not be staying there longer than the vacation time.

No you do not need a K-1 visa to go to the USA and marry.

However you must return back to Canada and file for a spousal visa if you wish to return and live in the USA.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

However you must return back to Canada and file for a spousal visa if you wish to return and live in the USA.

Yes I plan on returning to Canada temporarily after marriage. Thanks for answering. :) We've been confused about this for a while now.

Yep make sure to read up on the spousal visa process, they have step by step guides in the guide section as well as information in the comparisons link in the guide section.

It will be about 9-10 months ish before you will be issued the visa and able to return to the USA to live.

I notice that it doesn't include anything there about the Form I-485 (Application to Register Permanent Residence or Adjust Status). Is that form not needed?

For your situation, returning to Canada after marriage, no the I485 is not necessary
