How am I able to fill out the i-864 if my domicile isn't in the U.S.? Im am petitioning for my Canadian husband and we are both living in Canada. Is there another form im going to have to fill out. Omg a family member asked me this question and now im stressing out?????? Help!!! anyone, someone????

You would have to show proof that you were residing abroad temporarily, or intend to reestablish your domicile in the US before date of entry with your husband. Signing a lease or a job acceptance letter are examples of proof.

Filing state taxes each year, maintaining bank accounts, owning property, or having a permanent mailing address are some examples of proof that you were only living abroad temporarily.

You will most likely need a joint sponsor for the income side of it, unless you have enough income now, that will continue after returning to the US (unlikely). OR you are a millionaire and have tons of cash & investments that it's coming out your ears!! (even more unlikely). LOL..a bit of an exaggeration, but you would need a GOOD amount of money in the bank to show you could support yourself & husband for atleast a year if not more I would think.

Hi Trojam 227, thanks for your response, but I think you miss understood me I've been living in Canada for almost 12 years with permanent residency. My husband and I have been married for almost 9 years. He has lost both of his parents and has no other family here in Canada and all of my family is in the U.S. So there no need for us to continue living here any longer as we both need to be with family. So my question is that on page 2 of the i-864 instructions it states under Who completes and signs the i-864 A sponsor completes and signs Form I-864. A sponsor is required to be at least 18 years old and domiciled in the United States. How am I going to be able to do this if I have resided in Canada and continue to do so? We are going to be staying with my Mother who is also going to co-sponsor my husband until we find a place of our own. We have joint property here in Canada along with joint bank accts. etc.

I wish I was a millionaire!!! LOL

I understood but you didn't say how long you have been living in Canada so was trying to cover all scenarios.

OK, so in your case you will have to show proof that you reestablished domicile before your husband's POE.

-Start having mail sent to your mom's house (your new permanent residence).

-Have a utility bill put in your name at that address.

-Come over and open a bank account if don't have one here yet.

-Apply for credit with your new address.

-File 2012 taxes (and previous 2 years) even if you weren't required to.

-Renew your US driver's license while you are here opening a bank acct.

-Register to vote at the DMV

-And start looking for jobs (that's where the job acceptance letter would help)

All suggestions...I'm sure others can give more ideas. And save any/all of the proof you did these things.

Hummmm, well I can't see any of this happening prior to us getting back home to the U.S. So I guess we will just have to wait and see what happens. Thank you very much for your suggestions though!! Hope your journey is going wonderful.

You're welcome...if you can't manage to do any of this, than a letter written by your mom stating that you & your husband will reside with her for as long as it takes for you get on your feet...something to that effect. Have her notarize it. Might be as good as a tenancy agreement. Good luck!
