Ok, here's somewhat of an unusual story. I have dated a guy in highschool (2007) and we planned on geting married in order to increase our chances of winning the Green Card lottery since we're both applying (we were young and dumb). But we didn't do it because of costs, wait time, plus we didn't want our parents to know. I went to the US a month after graduation (august 2008) on a F1 visa, I have lost touch with the boyfriend back home after about 2 months in America. In 2010 I met my SO who is an American citizen. We've lived together for a year and in summer 2011 I went back to my home country for a year in order to complete my 2 year home stay policy. We decided to get married and start the application for he K1 visa. And here come's the surprise. When I went to get a certificate stating I was single and free to marry it turns out I am divorced.....I've been in a marriage I have no idea about from july 22nd 2008 until march 2011.....With my highschool boyfriend.....There is nothing to prove we've been married, we never lived together, there is no stamp in my national ID, nothing, its just a bad mark in a database...Aside from shock and insane stress,my question is, how will this affect my K1 processing? It means I've been in a relationship with my current SO while being married. I will have a divorce certificate to attach to my application. We don't have money for a lawyer, and the fees for the visa and then AOS are outrageous as it is...Are we doomed? Thank you for your time

This is insane - you did not know you were married? How come?

I lost absolutely all contact with the boyfriend when I was overseas. He has connections here and the country is very corrupt. I assume he bribed the officials to make a marriage certificate just so he can double his chances of winning the Green Card and did the smae to end the marriage now that he's about to get married. He had my national ID that's needed for the marriage and forged my signature. I can't possibly take any measure to sue him or anything because I have no money for lawyers. So I will have to leave it at that and have a bad mark forever. If only the marriage was annuled instead of having a divorce. Another thing is that all people who are married get a stamp on their IDs and I don't have that. Also there is no record of a name change...I found out all about this today when I went to get a paper stating I'm single and free to marry....unbelievable. The shock is immense...

Wow so sorry for all this - in my opinion consult a lawyer !!! You may sue him as well as those who have helped him - a signiture investigation will show that you did not sign any documents. If I was in your place I would fight !!!!! This is a serious crime, do not leave things this way !!! I am very familiar with Moldova and I am sure that something may be done. Go to the police immediately and report it !!!

Wow so sorry for all this - in my opinion consult a lawyer !!! You may sue him as well as those who have helped him - a signiture investigation will show that you did not sign any documents. If I was in your place I would fight !!!!! This is a serious crime, do not leave things this way !!! I am very familiar with Moldova and I am sure that something may be done. Go to the police immediately and report it !!!

Thank you for your support but heh guess what, I jsut found out he works for the police now, so he has even more connections. I will try to do something about this and ask around. It's unbelievable what money and connections can do in this country...

As long as you have your divorce certificate you will be fine. I was in the same situation and was granted the visa.

Glad to see someone who was in the same boat as me. Please elaborate if you can though - have you been in a forged marriage as well in your country or a simple marriage? Were the consular officers understanding of the situation? They didn't have a problem that you've been divorced and engaged with little time in between?

My case was even worse than yours.

My husband married me ( religious ceremony) before his divorce was finalised. we had to apply for K1 visa as our marriage was not valid in Usa. we had to explain everything during the interview and thanks God they still granted us the visa.

Your fine unless you have already applied for the visa stating you are single and not divorced. The only thing you need is a divorce certificate from your home country make sure you translate it.
