Actually my international advisor at schools says my F1 status is still valid.

It's okay to apply for I-485 no matter it's approved or denied.

SEVIS is a whole separate system, having immigrate intent would only hurt obtaining a new visa, but once I'm here, it does not terminate my status at all.

I'm pretty sure I can fall back to F1 status. I'm just wondering if they could send another letter saying it's a fraud if the first denial letter does not say so?

(It is definitely not a fraud, I have enough evidence saying the first visa was probably printed wrong.)

Timeline

Non-immigrant vs. immigrant I believe only applies at POE (i.e. leaving the country and coming back on F-1 is tricky if you filed for AOS since you've shown immigrant intent) but you can stay in status if your status is valid.

I was in H1B during my AOS and was told to maintain it until a decision was made, so other statuses don't get canceled when you file. I even reentered the country after filing using my H1B (I didn't have AP yet).

You should be fine staying in F1, but don't leave and try to come back now since you've already demonstrated immigrant intent.

I actually have a similar question..I have had J1 visa for 3 summers now..only 3 months work and 1 travel..its a visa you get between your official school break. Do I still have the two year requirement?and if I do, how does it work?Do I need to be out of the states for two years or just without a J1 visa but have entered usa on ESTA?Sorry if it sounds confusing
