Hi.

My wife may be offered a job as a teacher (she is American) and might need to start before our I-130 or other forms are approved (I am Canadian). Here is my question.

We both live in Canada right now, and expect to send in our I-130 very soon. Like next month.

She might be moving in August to get set up in the US and begin her job near the beginning of the month. If we have already sent in our I-130, and she then moves, will this mess our processing up? I will still have to do the consular processing probably and I will still have my job in insurance while I wait, but I would just like to know if we would need to submit another I-130 since our situation has changed. Or do we just submit a form letting them know that her address has changed?

It appears my wife might be getting an offer from a school that has heard good things about her. It sucks that we won't be together, but she said it would be okay if she moved before I moved as long as it doesn't take too long. I told her that I cannot promise anything to do with the government. They are so unpredictable. In any case, does anyone know the process if this happens?

05/25/2022: Naturalization Certificate received in mail.

You wont get your visa anyways unless the US citizen proves they are moving back to the USA / have already moved back to the USA. Montreal US embassy wont issue the visa without proof of US domicile. They are very strict about this.

It sucks to be apart but in the long run it will work out better that way.

Ya it would suck. But it's so minor in the grand scheme of things. I think it would be worth it. As long as it doesn't go too long.

This brings up another question, though. I might just send an email to a border officer about this, but I was wondering if you knew off the top of your head if entering the US while the immigration papers are going through is acceptable. I'm from Canada and do not need a visa to enter the US technically, and would be able to prove that I will be returning to Canada since I still own property and a vehicle and other such stuff here. I was wondering if you've heard of people being turned away at the border if they've had an I-130 submitted already, though. The reason I ask is that, at least in my mind, if an immigrant were to enter the country and they've already applied for immigrant status, it would lead me to believe that they are trying to enter in order to immigrate and not visit. And I know (from about 100-200 times crossing the border that they always ask the purpose for your stay and I always say to visit family and friends. In my situation, I would just want to spend Christmas with my wife if not approved at that time yet. Do people have problems doing this?

Just bring ties to Canada showing you have to go back. You can visit, people visit all the time from Canada with petitions in process.
