I need some advice here.

We received a strange REF telling us that we need to fill a waiver, because we have filed more that one K1 petition. This is not true.We never fill before, nor me,nor my fiance.

We figure out that probably it is because we fill in jan but it was not accepted because it was not properly signed. Then we prepared new one and send it in May.

Do you guy think that this could be the reason?

I would guess that would be the reason. You *have* filed before and the petition was denied (I'm assuming you got a denial notice).

See: http://www.uscis.gov/graphics/lawsregs/han...IMBRA072106.pdf - for information on waivers.

I only offer advice - not even legal. Just the plain and simple kind.

Mew,

Sil needs to clarify what he means by "not accepted". Having a petition rejected for processing is not the same as having a petition processed and denied.

Possible clerical error here?

All the paperwork was returned back to us,including the check. On teh envelope was written that is not properly signed. We missed to sigh one of the"G" forms-mine.So i presume that it was not denied.

I told my fiance to write a letter explaining them all that and send it back with the REF.

Aaah. I see. So it was not denied, just returned so it'd be corrected, right? In this case, you could document the letter with a copy of the notice that you've gotten stating that signatures were missing.
