To try and make the situation brief..

Last summer I had a P1 Artist Visa for 2 months for when I went on tour with my band. That has now expired and is done.

At the end of last year I joined a new band and was approved for a year long P1 Artist Visa expiring Dec 21 2012.

Around 3 weeks ago, I left the band and was informed that when they found a replacement, the new member would replace me on the bands Visa petition, issuing the new member with a P1 Artist Visa and mine would become void as I am essentially not working for that "company" (band) any more.

My question is, if I file my application for the K1, but the new member has not taken my place yet on the P1 Visa petition, can I still be given my NOA2 approval if I have an active P1 Artist Visa? If not, can I cancel my P1 Artist Visa?

I'm assuming that having gone through two visa approvals and interviews in the past, this will only strengthen my case when applying and interviewing for my K1?

The I-129F petition has nothing to do with the status of your other visa so no need to cancel.

When they issue the K-1 they will cancel your P-1 if it is still current.

BTW, NOA-2 is the approval of the petition, not the visa. That comes after your interview.

I'm currently in the K1 process and moved to the U.S a couple weeks ago. I've been offered a hockey tryout with a minor professional team in the area. Is this allowed while in the K1 process or a bad idea?

Thanks, that puts my mind at ease.

The visa i would be on with the hockey team is the P1 visa.
